HomeMy WebLinkAboutBubbus Ltr to Tenant- Lease Violations 102221■■ South Bowman LLC June 1, 2021 David's Burgers Bowman LLC 102 Country Club Pkwy Maumelle, AR72113 RE: Notice of Lease Violations South Bowman L-C/David's Burgers 101 S Bowman Road Little Rock, AR 72211 Dear Tenant: This letter is to notify you of violations to the Lease Agreement dated February 15, 2011 at the above -named building. The specific violations are as follows: 1. Signage and Advertising - Lessee installed exterior signs and advertising without prior consent of Lessor. Per the lease, Lessee must provide Lessor with written letter outlining any additional and intended signage requests. This letter has yet to be submitted and Lessor desires to have one on file. See Section 17 of the lease agreement for your reference and the attached photographic evidence taken from the site on Friday May 28110 showing continued violations of said Section. 2. Tent Placement- Lessee has erected a portable tent in the parking lot without prior consent of Lessor. This is the third time said lent has been found to be in use by the Lessee and Lessor has requested the tent to be removed from the premises on multiple occasions. See Section 8 of the lease agreement along with attached photo evidence from the site on Friday, May 28'h outlining this violation. 3. Traffic managementfordrive-through and carry-outcustomera- Lessee has placed unauthorized signage on the North side of Building allowing customers to park in front of the building entrance. Furthermore, Lessee is allowing drive-thru customers to block traffic lanes and parking on both the East and South sides of the building. Lessee has also instructed its employees to take orders directly from parked vehicles while in the lot. Said actions are leading to interference with Common Area usage on these sections of the property. These parking violations have ultimately led to severe traffic congestion going into and out of the site and is severely disruptive to the overall operation of the site. Ultimately, a restaurant drive-thru was not concepted to be a part of the building's footprint and the site is suffering as a result. See Section 8 of lease agreement and the attached photo evidence taken from the site on Friday, May 28w. Lessor hereby executes their rights pursuant to the Lease to have the unauthorized signage removed immediately by Lessee. Lessor requests from Lessee submission of request for any signage installation that is not currently approved by Lessor in written form. Furthermore, in accordance with both the original lease and renewals signed thereafter, Lessor requests documentation of any approvals for existing signage of a temporary and/or permanent nature.
