Torrence, looks like you are finally done with us. I talked with Jamie Collins and he gave us the OK to
build our originally requested 13X22 foot deck. As I understand it, all we are supposed to do is have our
surveyor draw the replat showing the curved 7 foot line following the foot print of the deck to the
extent it encroached on the line. Hope that’s right. Anyway, thanks for your help over the passed few
months.

I have reviewed the documentation. The Board of adjustments approved the replacement of a 13'x21'
deck with a 13'x22' deck. This approval still stands. The applicant is able to build the requested 13'x22'
deck replacement. All conditions from the BOA approval still stand. The applicant will have to complete
a replat of the lot reflecting the original 7' setback with the minor adjustment within the setback line to
no more than what is needed for the encroachment of the deck.

Mr. Bujarski was granted a variance for a reduced front yard setback with the condition of re-plat
following BOA approval prior to obtaining a building permit.
Now it appears his surveyor erred regarding the existing building line which will now cause a further
reduced front yard setback v. what the BOA approved last month (see below)
Mr. Bujarski is now seeking administrative approval, if possible, in an effort to avoid another BOA
application.

Torrence, here is the survey with the deck ruffly drawn in by the people at Brooks. You can see they
calculate the northeast corner can only be. 11.5 feet in depth in stead of the requested 13 feet and still
satisfy the allowed 7 foot building line. The southeast corner will also be out of compliance, only to a
lessor degree. Can only that portion of the deck in question be allowed inside the building line with the
remainder of the property being based on the 7 foot building line. Basically, we are hoping you can
allow the approved building line follow the outline of our deck to the extend it encroaches the line.
We thought once the variance was granted everything would move along smoothly, but, as our original
survey was incorrect for technical reasons, our contractor is now going to be hard pressed to keep us on
his work calendar for the next month or two. Any help you can give us to dance around this situation
will be greatly appreciated.
