HomeMy WebLinkAboutZ-9500 Tolson A - Opposition 051821Opposition to the Goodwin’s rezoning to Commercial # PCD Z-9500 I’m the original owner and developer of the property in question and my property adjoins the Goodwin’s. The Noise, Traffic, Health & Safety, Environmental, Loss in Property Values, Illegal POA and Zoning violations, are some of the reason that we oppose this application to rezone for Commercial use along with the following legal issues: On October 14, 2019 the Goodwin’s received a Notice of Violation from the City Planning and Development Office for operating an Event center in a Residential Zoned Property. The Goodwin’s property is zoned R-2 Single Family District. On September 24, 2020 Little Rock City Planning Commission “DENIED” the rezoning request, however The Goodwin’s continued to hold Commercial Events. On December 1, 2020 the Little Board of Directors “DENIED” the Goodwin’s appeal of The City Planning Commission decision; however The Goodwin’s continued to hold Commercial Events. On December 14, 2020 The Department of Planning and Development sent The Goodwin’s a letter stating that the zoning for their property “Does not allow for an event center/wedding venue type Commercial use”, Therefore you are hereby “Directed to Cease All Commercial Activities on The Property Immediately “. Jamie Collins, Director, however The Goodwin’s continue to hold Commercial Events. On January 29, 2021 The Office of The City Attorney, Thomas Carpenter sent a letter to the Goodwin’s. The Failure immediately to cease and desist using the property for Commercial activities will force The City to take Legal Action. The Goodwin’s continued to hold Commercial Events. On March 5th, 2021 The Goodwin’s filed a motion in Circuit Court for a Stay Judgment and a Supersedes Bond in this matter involving a petition for Judicial review (Appeal) from the December 1, 2020 “DENIAL” by The City of Little Rock Board of Directors to rezone the Goodwin’s property to Commercial. The court finds that the petition for stay of Judgment and Supersedes Bond should be “DENIED” on March 5th, 2021 Circuit Judge Wendell Griffin. The Goodwin’s continued to hold Commercial events. On March 14th the Goodwin’s appealed Judge Griffin decision and again was “DENIED”. The Goodwin’s continued to hold Commercial Events. The Tolsons 27412 Kanis Rd Little Rock, Ar 72223
