Z-6113-B 2 Zoned: O-2 Conditional Use Permit (CUP) Variances Requested: A variance is requested from the sign height provisions of Section 36-553. Signs permitted in institutional and office zones. Justification: The applicant’s justification is presented per attached letter dated December 12, 2020. Present Use: Hotel Proposed Use: Hotel STAFF REPORT A. Planning and Development Civil Engineering: No Comment. B. Buffering and Landscape: 1. Any new site development must comply with the City’s minimal landscape and buffer ordinance requirements. 2. Any exiting landscape or irrigation disturbed by construction shall be repaired or replaced before completion and final acceptance of the project. 3. The City Beautiful Commission recommends preserving as many existing trees as feasible on this site. Credit toward fulfilling Landscape Ordinance requirements can be given when preserving trees of six (6) inch caliper or larger. C. Building Codes: No Comment. D. Staff Analysis: The O-2 CUP zoned property at 1401 S. Shackleford Road is occupied by a Residence Inn by Marriott Hotel. The property is located on the east side of Shackleford Road, south of Kanis Road, and north of Executive Center Drive. The Arkansas Heart Hospital property is adjacent to the south perimeter, a Hampton Inn hotel is located to the north and the east perimeter is bordered by Kaufman Road, a buffer of mature trees, and then Interstate 430. The property was developed as an extended stay hotel in 1996. As part of the CUP the applicant requested a variance for a free-standing sign to exceed the six-foot height maximum allowable for O-2 zoned properties. Staff recommended approval FEBRUARY 18, 2021 ITEM NO. 2 (CON’T.) Z-6113-B 3 of the CUP and Planning Commission passed the resolution unanimously. As part of this resolution an eight-foot monument sign located adjacent to the Shackelford Road right-of-way was also approved. The applicant is now requesting that all hotel signage be renovated and replaced. The wall signs will remain in the same location, approximately the same size with only updated graphics. It is also being requested that the existing eight (8) foot monument sign located adjacent to Shackleford Road be replaced with a pylon sign twenty (20) feet in height. The owner has stated that since the initial development the landscape has matured making the visibility of the sign from the road difficult to visually locate. In addition, the hotels parent company prefers that the street signage be of the pylon type design. Section 36-533(a)(2) states, one (1) freestanding sign per premises, not to exceed two (2) square feet in sign area for each linear foot of main street frontage up to a maximum of sixty-four (64) square feet. Such sign may not exceed a height of six (6) feet. While office zoned properties do not allow freestanding signs to exceed six (6) feet in height a precedence has been set by other business in close proximity to the applicant site. The adjacent Hampton Inn to the north, also zoned O-2 CUP has been allowed a pylon sign approximately twenty (20) feet in height. Additionally, while characterized by different zoning (PCD) the Lexus dealership facing the subject property on the west perimeter of Shackelford Road and the Shell convenience store / service station located on the southwest corner of Shackleford and Kanis Roads have both been allowed a free standing sign that exceed the height of the sign being requested. The height variance for the free-standing sign would not be out of character with signage of the adjacent hotel north property. Additionally, pylon signage on the west side of Shackleford Road has been allowed which exceeds the O-2 zoned property requirement of a six (6) foot height maximum. The attached survey indicates the location of the existing monument sign and the proposed pylon sign to be located north of the property line (off-site). E. Staff Recommendation: Staff recommends approval of the twenty (20) foot pylon sign as presented in the attached graphics package, with the condition that the sign be installed on the applicant’s property or written approval is provided from the adjacent northern property owner stating the location, style, and design of the sign is acceptable prior to the issuance of a sign permit.
