Subject: #Variance Request - 5423 CC Blvd
Good morning, Ellen. We’ve had a look at your variance application for 5423 CC. Regarding proposed
structures on the E. property line, your letter states, “Our new patio would sit on a brick faced retaining
wall that would end on the east property line and a new fence or brick wall will be constructed above for
privacy.
My interpretation is there will an elevated retaining wall on the property line, with a privacy fence or
wall on top of that, with a roof. Am I understanding correctly? Will the roof be cantilevered or will it
require support columns/posts? What are the heights of the ret. wall, privacy wall/fence, and
cover? How is run-off managed? Etc.
An elevation drawing will provide clarity (see attached sketch – something like that,) and
acknowledgement from the adjacent owner that they’re ok with the proposed work is appropriate.
Please provide additional info.
After yesterday’s BOA submittals, it looks like you’ll be sharing the Feb. 18 agenda with six or seven

Ellen - I’m writing between PC agenda items:
- For the fence, either apply for a replaced fence/brick wall just inside the property line;
OR
Apply jointly (both owners) for a fence/brick wall to straddle the property line.
- For the overhang, with no screen, no wall, we’ll support as close as 1’ to the property line, including
guttering... Provide written indication of support from adjacent owner if available.
As you know, I’m establishing my rules of thumb throughout the code(s), attempting to be prudent - not
too lenient nor too hard-line. Let me know if you have questions or comments. We look forward to your
application.
