Enclosed please find an application for a variance requesting a reduction of the freeway buffer from 30'
to 15' along the west side of the above referenced lot which is adjacent to the northbound lane of 1-430.
The variance is to seek relief from the conditions set forth in Section 36-522, A.3, in the Zoning
Ordinance. This lot is currently zoned 0-3.
The applicant desires to develop the site for a 6435 square foot medical clinic with associated parking,
driveways, and landscaping. The attached site plan shows the minimal amount of parking, driveways,
and sidewalks that are required for the safe and efficient operation of this facility. All other buffers,
setbacks, and landscape requirements are being met.
The applicant is pursuing this variance due to a lack of overall depth in this lot. If the full requirement of
the ordinance is imposed on this site, then a hardship is created making this site undevelopable in any
reasonable or economic sense.
The applicant also cites precedent for this request in that the apartment development immediately to
the south of this site was granted a 50% reduction in the freeway buffer for many of the same reasons
contained in this application.
The applicant would also like to point out that approximately 65' of mature hardwoods, pines, and
undergrowth now exists between this site and the freeway which will result in an overalleffective
undisturbed buffer of approximately 80'.
The applicant is also willing to discuss additional landscape enhancements to the remaining buffer if
granted this variance.
