Pierce - Variance Application Ms. Miller, this note acknowledges receipt of your 12/13/2020 email expressing opposition to the variance requested by the above-mentioned applicant. Your email has been forwarded for consideration by the Board of Adjustment at its hearing today, 12/17/20. To clarify, the subject application proposes a swimming pool and hot tub in the rear yard. With this application, no structure(s) other than the relatively flat pool/terrace is proposed. No additional structure or building is proposed within 6 feet of an adjacent residence. The City Code offers no limit to the amount of paved surface (ie, patio, terrace, basketball or tennis court, etc.,) therefore the interpretation consistently applied by the City relating to pools and pool decks is applied similarly to the other forms of paving the code allows by right and requiring no variance. Pierce requesting a variance In reference to the zoning request for the home at 2909 N. Pierce Street. Please deny the request. The Heights Neighborhood is being destroyed by homes that are too big for the lot. The house in question covers all of the lot and to add more structures would degrade the property even more. Why would you allow a property to be located less than 6 feet from another home ,and violate your own zoning ordinance, which was put into place to protect the integrity of neighborhoods. The planning commission continues to allow builders and developers to obtain variances throughout the city especially in the Heights.
