CASE HISTORY:
August 21, 2019 - Applicant submitted a variance request to the BOA for a reduced rear yard
setback to build an attached 39’-6” wide garage in the 25-foot required rear yard.
September 30, 2019 - Variance request was unanimously denied by the BOA. (BOA chair offered
the opportunity for deferral, which was refused by the applicant.)
October 4, 2019 – Applicant was mailed formal notice of the variance denial (including courtesy
reminder of the 30-day window to appeal. No appeal was filed.)
December 6, 2019 - Applicant submitted a building permit application with no attached garage in
the required rear yard. Building permit was issued to Terra Firma Project, LLC.
April 8, 2019 - Applicant requested a footing inspection for the rear slab. Inspector Randy Baldwin
approved the footing as portrayed in the approved building permit. There was no structure in the
25-foot required rear yard at that time.
June 5, 2020 - Staff received a complaint from neighbors concerning a structure being built in the
rear setback at 5205 Kavanaugh Blvd..
June 5, 2020- Staff investigated the complaint and found a 2-story garage structure constructed in
the 25-foot required rear yard. Officer Bart Jones posted a stop work order on the structure.
June 8, 2020 – Officer Steve Coleman contacted applicant Billy Collins via phone and informed
him of the set-back violation. Applicant stated he was out of town and would contact us when he
returned; applicant asked if he could pay a fine to allow the garage to remain.
June 10, 2020 - Bart Jones and Steve Coleman met applicant Billy Collins at the site. Staff issued
a warning notice giving Mr. Collins seven days to remove the violation.
June 16, 2020 - Bart Jones contacted Mr. Collins and explained the 7 days were up. Mr. Collins
was informed he would be issued a citation to appear in Little Rock Environmental court for failing
to remove the violation. Mr. Collins stated he would not meet with Mr. Jones and requested the
citation be mailed to him.
June 16, 2020 - The citation was prepared by Mr. Jones and mailed via certified and regular mail
to Mr. Collins at his personal address, his business address and the subject property.
June 17, 2020 – Department of Planning and Development received notice that Tre Kitchens
of the Brad Hendricks Law Firm represents Mr. Billy C. Collins, Jr., manager of Terra Firma
Project, LLC.
July 29, 2020 - Applicant submitted a variance request to the BOA for an existing 40-foot-wide
garage in the 25-foot required rear yard. At this time, additional inconsistencies (existing reduced
side yard setback, and proposed reduced separation between an accessory structure and primary
residence) were identified as part of the application and submitted site plan. Additional
inconsistencies were identified in the field, suggesting the existing structure does not match (and
may be larger than) the July 29 application portrayal.
