The outer portion of the retaining wall foundation should be located outside of the right-of-way on private property. If the retaining wall is 4 ft or taller, an engineer's design certification is required. Attached is the CLR Engineer's design certification form. If the existing trees are proposed to be removed and they are located within the public right-of-way off the subject property, the CLR Urban Forester, Robby Hudson, must be contacted for approval of the removal of the trees. Dash - dot - dot - dash is the property line. The property line in question runs parallel to Kavanaugh on the north side of our property. It's probably -20' from the street. The "dash only" line is the 5' side yard set back off the property line that Brian had identified for us in the first phase of this prior to taking it to an architect. I checked your plans against the Hillcrest DOD. Your numbers are good either way you go. I checked with Monte Moore. He does Board of Adjustment. He recommended the you check with Public Works on this. I have included Vince Floriani in this email. It Public Works will sign off on it, then you can file for a BOA side yard variance. Monte thinks it has a fair chance of approval. If you file for the BOA, you will need a survey from a surveyor to say exactly how far away from the line you are. You will need that survey to get your building permit also. One that combines a carport + bedroom into one building, and the other that creates an attached bedroom addition + detached car port. You can see where we are proposing locating the northeast comer of the building (or buildings) onto the 5-foot setback line, on the north side of our property, which runs up to Kavanaugh, just west of Midland Street. Subject: 524 Midland Street - trees on city property questions Dear Robbie, Hope you are well. Thanks for the recommendations on getting help for that post oak in our backyard. I've got a plan in place to do some soil removal (recommended by some folks at UALR cooperative extension), and Peter Rausch will be coming out this week to add his thoughts. On a different note, we're contemplating a carport and room addition on the north side of our property at 524 Midland and will be applying for a variance to do so. There are 3 trees on City of Little Rock property (a walnut, hickory, and ... maybe another type of hickory or ash) that are close to where the new addition would be. Basically, they're between our driveway and Kavanaugh just north of our property line, and kind of intertwined with an ancient retaining wall that is also on CLR property, We have planned the addition and site in such a way that we would try to minimize impact to the trees (we love them and want all the foliage around our house we can get!) However, Vince Florian told me that I needed to notify forestry to ensure that the plan we're going for is approved by y'all, in case there would be any effect on the trees.
