Sec. 36-254(d)(1) to reduce the required front yard setback
from 25 feet to 17 feet.
Justification: The applicant’s justification is presented in a May 11, 2020
email accompanying the variance application. Via June 12
telephone and email, applicant has altered the request as
described below.

A. Engineering Issues:

B. Staff Analysis:
The R-2 zoned property located at 21 Irish Rose Circle is occupied by a one-story
single-family residence. A two-car-width driveway exists to the southwest of the
residence, and a brick sidewalk extends from the front entrance/porch westerly to
the street. The front yard is generally flat and retains water during rains, warranting
an elevated front porch or deck at said entrance.
The applicant wishes to replace and expand the existing 34”-high front porch decking
from its existing 4-foot depth to a depth of 8 feet, to allow better circulation and
adequate elevated area for residents and guests to enter the home and/or occupy
the porch. The proposed porch will not be enclosed and will feature steps and railing
per applicable codes for decking.
Section 36-254(d)(1) states, “There shall be a front yard setback having a depth of
not less than twenty-five (25) feet.”

Note: The applicant originally submitted a request for a reconstructed front deck
double the depth currently proposed. After discussing issues associated with
neighboring properties, the principles of front yard setbacks, and the neighborhood
context, the applicant agreed to reduce the proposed depth by 50 percent, generally
preserving a front yard that remains similar and compatible with other properties on
Irish Rose Circle.
No objections to the proposed improvements by neighboring property owners are
known as of this writing. Staff views the variance request as reasonable and is
supportive for the above-stated reasons.
C. Staff Recommendation:
Staff recommends approval of the requested/submitted front yard setback
variance, reducing the front yard from 25 feet to as much as 17 feet, and allowing
an 8-foot deep, 32-foot wide, 34” high deck.
