HomeMy WebLinkAbout15614 1 RESOLUTION NO. 15,614 2 3 A RESOLUTION EXPRESSING THE WILLINGNESS OF THE CITY OF 4 LITTLE ROCK, ARKANSAS; TO APPLY FOR, AND UTILIZE, COST 5 SHARE GRANT FUNDS FROM THE UNITED STATES ARMY CORPS OF 6 ENGINEERS FOR CLEARING AND CHANNEL IMPROVEMENTS TO 7 STUMP CREEK, SOUTH OF AREHART DRIVE AND EAST OF RECK 8 ROAD; AND FOR OTHER PURPOSES. 9 10 WHEREAS,the City of Little Rock has received a preliminary offer of cost share funding under the 11 United States Army Corps of Engineers CAP Section 208 Program for clearing and snagging improvements 12 on Stump Creek in Ward 2; and, 13 WHEREAS,it is desirable to pursue this offer of funding as improvements to Stump Creek is expected 14 to be a benefit to area residents to reduce the frequency and severity of local flooding. 15 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 16 OF LITTLE ROCK,ARKANSAS: 17 Section 1. The Board of Directors hereby pledges its full support for the Stump Creek Clearing and 18 Snagging Project and will participate in accordance with its designated responsibilities, including 19 acquisition of easements, land and right-of-way and maintenance of this project upon completion, and to 20 provide cost share funds for the project. 21 Section 2. In the event that the grant funds are awarded,the City Manager, or his authorized designee, 22 are hereby authorized and directed to execute all appropriate agreements and contracts necessary to expedite 23 the planning, acquisition of easements, land and right-of-way, and construction of the above stated project. 24 Section 3.The estimated funding for this project will be Three Hundred Twenty-Five Thousand Dollars 25 ($325,000.00) from the Corps of Engineers, with the City share estimated at Four Hundred Thousand 26 Dollars ($400,000.00). Funding for the Stump Creek project is from the 3/8-Cent Capital Improvement 27 Sales Tax and the Limited Tax General Obligation Improvement Bonds previously allocated for the 28 Yorkwood Drainage Project in Ward 2 by Resolution No. 14,803 (June 19, 2018); and funding for the 29 Yorkwood Drainage Project is from the American Rescue Act Funds for Water and Sewer Infrastructure 30 Improvement Projects as authorized by Resolution No. 15,524(August 17, 2021). 31 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 32 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 33 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and [Page 1 of 2] 1 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 2 resolution. 3 Section 5.
