CODE 4 CHAPTER 32, ARTICLE X, § 34-134 THROUGH § 34-135; TO PERMIT 5 THE OPERATION OF PEDICABS IN PREAPPROVED LOCATIONS, 6 SUCH AS ENTERTAINMENT DISTRICTS WITH FIXED ROUTES; AND 7 FOR OTHER PURPOSES. 8 9 WHEREAS,the Board of Directors of the City of Little Rock,Arkansas,has adopted a Comprehensive 10 Transportation Code which governs the operation of vehicles for hire within the corporate limits of the City; 11 and, 12 WHEREAS,there is now a desire to amend Article X of the Transportation Code; and, 13 WHEREAS, City of Little Rock has determined that allowing the operation of Pedicabs within 14 permitted zones of operation such as Entertainment Districts and other preapproved fixed routes will 15 promote hospitality and tourism within the City. 16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 17 OF LITTLE ROCK,ARKANSAS: 18 Section 1. Little Rock, Ark., Rev Code §34-134 is hereby amended to read as follows: 19 Sec. 34-134.- Pedicab Permitted Zones of Operation and Preapproved Fixed Routes; 20 Hours of Service. 21 (a) Permitted Zone of Operation. Pedicabs may only operate and carry passengers within 22 designated Entertainment Districts. The director may prohibit the operation of Pedicabs on 23 streets if, in the opinion of the fleet director, conditions warrant such prohibition. 24 (b)No pedicab shall be parked on any sidewalk or walkway. 25 (c) Pedicabs shall not operate during the non-holiday weekday rush hours of 7:00 AM to 26 9:00 AM. 27 Section 2. Little Rock, Ark., Rev Code §34-135 is hereby amended to read as follows: 28 Sec. 34-135.-Pedicab Service Area Exception Permit. 29 (a) If a holder of Pedicab Certificate of Convenience and necessity desires to provide 30 pedicab service in areas other than the designated Entertainment Districts, the holder shall 31 obtain a Pedicab Service Area Exception Permit from the Director at least twenty-four (24) 32 hours before use of the permit. Such permit shall not be issued without the submission of a 33 written application for the Director's review and approval. The application shall state the need [Page 1 of 21 1 for the permit, identify the Pedicabs to be used and identify the desired route and time of the 2 pedicab service. 3 (b) Upon approval of the application and issuance of the Pedicab Service Area Exception 4 Permit. The Director may condition the permit upon any requirement that the Director deems 5 to be in the interest of public safety, including, but not limited to, requiring the holder to have 6 a vehicle escort following the pedicab on major thoroughfares or requiring additional 7 temporary lighting on the pedicab. 8 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 9 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 10 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 11 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 12 ordinance. 13 Section 4. Repealer.
