3 A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A
4 CONTRACT WITH SOUTHPORT PROPERTIES, LLC, CHARLES
5 THOMAS, RUTH THOMAS, CHARLES R. THOMAS LIVING TRUST
6 AND RUTH L. THOMAS LIVING TRUST FOR THE PURCHASE OF
7 APPROXIMATELY 300 ACRES OF LAND, FOR USE BY THE LITTLE
8 ROCK PORT AUTHORITY FOR ECONOMIC PROSPECT
9 RECRUITMENT; AND FOR OTHER PURPOSES.

11 WHEREAS,the City of Little Rock,Arkansas,through its 2011 Capital Sales Tax Initiative,set aside
12 money for the specific purpose of expanding the real estate holdings of the Little Rock Port Authority;and,
13 WHEREAS,the Little Rock Port Authority has been actively exploring opportunities for expansion,
14 including the development of a 2008 Master Real Estate Acquisition Plan; and,
15 WHEREAS, the Little Rock Port Authority Staff has worked with the Greater Little Rock Regional
16 Chamber of Commerce,and other interested parties,to explore viable options for real estate expansion and
17 determined that this particular parcel will meet the future needs of the Little Rock Port Authority for
18 economic prospect recruitment purposes; and,
19 WHEREAS,the Little Rock Port Authority Staff has extended a preliminary offer,based upon a third-
20 party appraisal,for the property in question and the offer has been accepted by the owner.
21 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
22 OF LITTLE ROCK:
23 Section 1. The City of Little Rock Board of Directors authorizes the Mayor to purchase approximately
24 300 acres of land for a purchase price of Four Million Dollars($4,000,000.00),plus associated closing cost,
25 and is contingent upon positive findings of the Phase One Environmental Study and determination of clear
26 title. The property is defined as portions of the following:
27 Tract 1: Part of the Northeast Quarter(NE1/4) of the Northeast Quarter(NE1/4) Section
28 28, Townshipl North, Range 11 West, Pulaski County, Arkansas, more particularly
29 described as follows: Beginning 773 feet south and 585.8 feet west of the northeast corner
30 of the Northeast Quarter (NE1/4); thence North 88 degrees 30 minutes West 328.2 feet;
31 thence North 20 degrees 20 minutes East 312 feet; thence North 10 degrees 20 minutes
32 East 479 feet to an iron pin on the north line of said Section 28; thence east along the
33 Section line 155.5 feet to a point which is 585.5 feet west of the northeast corner of said

1 Section, thence South 1 degree 30 minutes West parallel to the East line of Section 28,
2 Township 1 North,Range 11 West to the point of beginning.

4 Pulaski County, Arkansas, more particularly described as follows: Beginning at the
5 northeast corner of the SW1/4 NE1/4 and running north 190 feet; thence east 387 feet;
6 thence south 190 feet;thence west along the north line of SE1/4 NE1/4 387 feet to the Point
7 of Beginning.
8 Tract 3: The Southwest Quarter(SW1/4)of the Northeast Quarter(NE1/4)of Section 28,
9 Township 1 North,Range 11 West,Pulaski County,Arkansas.

9 Section 2. Funding for this acquisition will come from the Little Rock Port Authority's Land
10 Acquisition Account
11 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
12 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
13 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
14 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
15 resolution.
16 Section 4. Repealer. All laws ordinances resolutions or parts of the same that are inconsistent with
17 the provisions of this resolution are hereby repealed to the extent of such inconsistency.
