HomeMy WebLinkAbout15541 1 RESOLUTION NO. 15,541 2 3 A RESOLUTION TO GRANT THE AUTHORITY TO SUBMIT BIDS TO 4 PURCHASE PROPERTIES AT THE ARKANSAS STATE LAND 5 COMMISSIONER'S 2021 AUCTION, TO BE USED FOR 6 NEIGHBORHOOD REVITALIZATION PROGRAMS; AND, FOR 7 OTHER PURPOSES. 8 9 WHEREAS, the Board of Directors has stated as one of its goals a desire to provide for 10 neighborhood revitalization, and has taken special efforts to accomplish this goal through its use of 11 various City and Federal Funds, and through affirmative actions, such as, the creation of the Land Bank 12 Commission;and, 13 WHEREAS, in order to accomplish this goal it is required that properties be obtained by the City in 14 areas that are appropriate for revitalization;and, 15 WHEREAS,the Land Bank Commission has identified six(6) properties within its focus area which 16 can be used to fulfill the City's stated goals;and, 17 WHEREAS, pursuant to Arkansas State Law, the City must obtain authority to submit bids to 18 purchase property from the Arkansas State Land Commissioner by a resolution adopted by the Board of 19 Directors. 20 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 21 OF LITTLE ROCK,ARKANSAS: 22 Section 1. Pursuant to Ark. Code Ann. § 14-54-302(c) (West Supp. 2010), the City must obtain 23 authority from the Board of Directors to submit bids to purchase up to six (6) properties from the 24 Arkansas State Land Commissioner, not to exceed the sum of Thirty Thousand Dollars($30,000.00). 25 Section 2. If the bids are accepted, the Board of Directors, pursuant to Ark. Code Ann. § 14-54- 26 302(c) (West Supp. 2010), must authorize the Mayor and City Clerk to execute any documents necessary 27 to complete the purchase of the properties. 28 Section 3. If acquired, these properties shall be used for a public purpose, specifically for City 29 Neighborhood Revitalization Programs. 30 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 31 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 32 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 33 effect a if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 34 ordinance.
