HomeMy WebLinkAbout15528 1 RESOLUTION NO. 15,528 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR OR CITY MANAGER 4 TO ENTER INTO A CONTRACT TO SELL REAL ESTATE FOR 5 HIGHWAY PURPOSES AND TO TRANSFER OWNERSHIP OF REAL 6 PROPERTY FROM THE CITY OF LITTLE ROCK, ARKANSAS, TO 7 THE ARKANSAS DEPARTMENT OF TRANSPORTATION; AND FOR 8 OTHER PURPOSES. 9 10 WHEREAS, the Arkansas Department of Transportation (ArDOT) has developed plans for the 11 reconstruction of the Gill Street Overpass on State Highway 10, Cantrell Road, ArDOT Job No. 061454; 12 and, 13 WHEREAS, a small parcel of land needed for construction of the overpass is owned by the City and 14 is currently under a long-term lease to Dillard's, Inc., for use as their corporate headquarters; and, 15 WHEREAS, it is desirable that the City of Little Rock would transfer the ownership of this property, 16 with the concurrence of the lease,to ArDOT for this important Transportation Improvement Project. 17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF 18 LITTLE ROCK,ARKANSAS: 19 Section 1. The Mayor, City Clerk, and City Manager are hereby authorized to execute, in a form 20 approved by the City Attorney, any sales contracts and documents required to donate or sell and convey 21 to the Arkansas Department or Transportation,the land located in Pulaski County, Arkansas, described as 22 Tract 11 on the right-of-way maps of ArDOT Job 061454, attached as Exhibit A, and further described as 23 follows: 24 Part of Lot 1,Dillard's Addition,being in the Northeast Quarter of Section 4,Township 1 25 North,Range 12 West, Pulaski County,Arkansas, more particularly described as follows: 26 BEGINNING at a 1.25-inch rebar being used as the southwest corner of Lot 1, Dillard's 27 addition recorded in Deed Record Book D, Page 788; said point being on the northerly 28 right-of-way line of Arkansas State Highway 10(Cantrell Road)as established by AHTD 29 Job No. 6678; thence North 02°12'15" East a distance of 47.88 feet to a point on the 30 Northerly right of way line of Arkansas State Highway 10 (Cantrell Road) as established 31 by ArDOT Job No. 061454; thence South 57°17'12" East along said right-of-way line a 32 distance of 55.01 feet to a point; thence South 68°50'03" East along said right-of-way 33 line a distance of 80.16 feet to a point; thence South 73°20'42" East along said right-of- (Page 1 of 31 1 way line a distance of 82.26 feet to a point; thence South 79°58'25" East along said 2 right-of-way line a distance of 107.84 feet to a point on the northerly right-of-way line of 3 Arkansas State Highway 10 (Cantrell Road) as established by AHTD Job No. 6678; 4 thence North 84°01'38" West along said right-of-way line a distance of 118.61 feet to a 5 point;thence North 77°51'53" West along said right-of-way line a distance of 194.26 feet 6 to the point of beginning and containing 4,833 square-feet, more or less, as shown on 7 plans prepared by the ArDOT and referenced as Job No. 061454. 8 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 9 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 10 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 11 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 12 resolution. 13 Section 3. Repealer.
