HomeMy WebLinkAboutjudges orderIN THE COUNTY COURT OF PULASKI COUNTY, ARKANSAS FILED APR 14 2021 TERRI HOLLINGSWORTH CIRCUIT COUNTY CLERK IN THE MATTER OF ANNEXING TO THE CITY OF LITTLE ROCK, ARKANSAS CERTAIN TERRITORY LOCATED IN THE SE1/4 SE1/4 OF SECTION 35 AND THE SW1/4 SE1/4 OF SECTION 35, TOWNSHIP 2 NORTH, RANGE 14 WEST, PULASKI COUNTY, ARKANSAS, INCLUDING ALL ADJACENT RIGHTS OF WAY, CONTIGUOUS TO THE CITY OF LITTLE ROCK, ARKANSAS NO. CI-2021-9 2GZ ORDER On March 19, 2021, Petitioner filed its Petition for Annexation pursuant to Arkansas Code Annotated § 14-40-609, which provides a process for annexation of property by a petition of 100% of the owners of the subject property. On April 9'h, 2021 and March 22, 2021, the county assessor and the county clerk, respectively, timely filed verifications recognizing that the petitioner's identity is verified by notarized signature to the Petition; that the Petitioners have attested that the Petitioner owns one hundred percent (100%) of the property for which annexation is sought; and that Petitioner attached the letter of WACO Title Company, a qualified title company, to its Petition, finding ownership in Petitioner and no ownership or interest in any person or entity other than Petitioner; and Petitioner attached the letter of Jennifer Wheeler, indicating that the property is contiguous to and adjoins an already established boundary of the City of Little Rock and finding that the proposed annexation will not create an enclave if accepted by the City of Little Rock. This Court, having reviewed the Petition, Attachments and Verifications, is satisfied that all are complete and accurate; and confirms that the Petition contains a schedule of services; and hereby issues this Order. As such: IT IS THEREFORE, CONSIDERED, ORDERED AND ADJUDGED by the Court that the following described area, all lying wholly within Pulaski County, Arkansas, to wit: 1 LEGAL DESCRIPTION: A part of the Southeast Quarter of the Southeast Quarter of Section 35 and a part of the Southwest Quarter of the Southeast Quarter of Section 35, lying in Township 2 North, Range 14 West, Pulaski County, Arkansas and being more fully described as follows: Commencing at a Found Axle, marking the Southeast Comer of the Southeast Quarter of the Southeast Quarter of Section 35 and run thence North 01 deg. 35 min. 44 sec. East along the East line thereof for a distance of 205.18 feet to a point on the North Right -of - Way line of Kanis Road; thence North 88 deg. 01 min. 19 sec. West along said North Right -of -Way line for a distance of 107.89 feet; thence North 87 deg. 40 min. 59 sec. West along said North Right -of -Way line for a distance of 215.43 feet to the Southwest Corner of Tract 15, Independence Farms Subdivision, Unit 1, also being the Point of Beginning of the land herein described; thence North 01 deg. 07 min. 05 sec. East along the West line of said Tract 15 for a distance of 318.90 feet; thence South 87 deg. 27 min. 22 sec. East for a distance of 215.45 feet, to a point on the East line of said Tract 15; thence North 01 deg. 07 min. 05 see.
