3 AN ORDINANCE TO ACCEPT THE CYPRESS BEND
4 KANIS ANNEXATION (A-339), TO ADD CERTAIN
5 LANDS TO THE CITY OF LITTLE ROCK,
6 ARKANSAS; AND FOR OTHER PURPOSES.

8 WHEREAS, a petition for voluntary annexation (the "Petition") was filed with the
9 County Clerk of Pulaski County, Arkansas, for 100 percent owner praying that said lands be
10 annexed to and made part of the City of Little Rock, Arkansas; and,
11
12 WHEREAS, the County Court of Pulaski County, Arkansas found that the Petition
13 was correct as to form as required of Arkansas Code 14-40-609; and,
14
15 WHEREAS, the Pulaski County Judge has signed an Annexation Order for the site
16 requesting annexation (April 14, 2021); and,
17
18 WHEREAS, an accurate map of said lands has been filed with and made a part of said
19 Petition; and,
20
21 WHEREAS, all things pertaining thereto have been done in the manner prescribed by
22 law and that said lands should be annexed to and made part of the City of Little Rock.

24 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
25 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:

27 SECTION 1. The following described territory contiguous and adjoining the City of
28 Little Rock, Arkansas is accepted as annexed to and made a part of the City of Little Rock,
29 Pulaski County, Arkansas, to wit:

3 A part of the SE 1/4 of the SE 1/4 of Section 35 and a part of the SW 1/4 of the
4 SE 1/4 of Section 35, lying in Township 2 North, Range 14 West, Pulaski
5 County, Arkansas and being more fully described as follows: Commencing at a
6 Found Axel, marking the SE Corner of the SE 1/4 of the SE 1/4 of Section 35 and
7 run thence North 01 deg. 35 min. 44 sec. East along the East line thereof for
8 a distance of 205.18 feet to a point on the North ROW line of Kanis Road;
9 thence North 88 deg. 01 min. 19 sec. West along said North ROW line for a
10 distance of 107.89 feet; thence North 87 deg. 40 min. 59 sec. West along said
11 North ROW line for a distance of 215.43 feet to the SW Corner of Tract 15,
12 Independence Farms Subdivision, Unit 1, also being the Point of Beginning of the
13 land herein described; thence North 01 deg. 07 min. 05 sec. East along the West
14 line of said Tract 15 for a distance of 318.90 feet; thence South 87 deg. 27 min.
15 22 sec. East for a distance of 215.45 feet, to a point on the East line of said
16 Tract 15; thence North 01 deg. 07 min. OS sec. East along the East line of said
17 Tract 15 for a distance of 283.10 feet to a Found 1" Pinched Pipe, being the NW
18 Corner of Tract 14, Independence Farms Subdivision, Unit 1; thence South 87
19 deg. 27 min. 22 sec. East along the North line of said Tract 14 for a distance of
20 13.37 feet; thence North 44 deg. 13 min. 06 sec. West for a distance of 323.44
21 feet to a point on the Eastline of the West 990 feet of the SE 1/4 of the SE 1/4 of
22 Section 35; thence North 00 deg. 46 min. 58 sec. East along said East line for a
23 distance of 321.91 feet to a point on the North line of said SE 1/4 of the SE 1/4 of
24 Section 35; thence North 88 deg. 41 min. 06 sec. West along the North line of said
25 SE 1/4 the SE 1/4 of Section 35 for a distance of 1031.13 feet, to the NE 1/4 of the
26 SW %4 of the SE 1/4 of said Section 35; thence North 88 deg. 41 min. 06 sec. West

2 angle of 03 deg. 38 min. 12 sec., a radius of 1597.99 feet; a chord bearing and
3 distance of South 64 deg. 16 min. 48 sec. East for 101.41 feet; thence 107.89 feet
4 along said North ROW line to the Point of Tangency of said curve to the right;
5 thence South 62 deg. 29 min. 56 sec. East along said North ROW line for a distance
6 of 251.99 feet; thence South 63 deg. 02 min. 39 sec. East along said North ROW
7 line for a distance of 35.25 feet; thence South 64 deg. 06 min. 26 sec. East along
8 said North ROW line for a distance of 360.21 feet to the Point of Curvature of a
9 curve to the left that has a delta angle of 21 deg. 46 min. 12 sec., a radius of
10 1336.03 feet, a chord bearing and distance of South 74 deg. 59 min. 32 sec. East
11 for 504.59 feet; thence an arc distance of 507.63 feet along said North ROW line to
12 the Point of Tangency of said curve to the left; thence South 88 deg. 19 min. 18 sec.
13 East along said North ROW line for a distance of 178.27 feet to the Point of
14 Beginning, containing 1,466,990.45 square feet or 33.68 acres, more or less.,
15 including all adjacent, abutting and Traversing Roads and Rights -of Way.

17 SECTION 2. The City of Little Rock shall provide police and fire protection; and
18 upon approval by the respective utility allow the property owners within the annexation to
19 extend service lines to the Little Rock Water Reclamation system and Central Arkansas Water
20 system from the effective date of the annexation.

22 SECTION 3. Severability. In the event any title, section, paragraph, item, sentence,
23 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
24 unconstitutional, such declaration or adjudication shall not affect the remaining portions of the
25 ordinance which shall remain in full force and effect as if the portion so declared or adjudged
26 invalid or unconstitutional was not originally a part of the ordinance.

28 SECTION 4. Repealer. All ordinances or resolutions of the City in conflict herewith
29 are hereby repealed to the extent of such conflict.
