3 AN ORDINANCE TO CREATE A NO-WAKE ZONE FOR A SEGMENT OF
4 THE LITTLE MAUMELLE RIVER, LOCATED WITHIN THE
5 CORPORATE LIMITS OF THE CITY OF LITTLE ROCK, ARKANSAS;
6 AND FOR OTHER PURPOSES.

8 WHEREAS, numerous small vessels are routinely accessing the Little Maumelle River, which is a
9 tributary of the Arkansas River,just west of the Two Rivers Park Bridge within the corporate limits of the
10 City of Little Rock, Arkansas; and,
11 WHEREAS, larger, motor-driven vessels have been observed speeding through this area and causing
12 large wakes that threaten the safety of occupants in smaller vessels; and,
13 WHEREAS,Little Rock Parks and Recreation has obtained a permit from the U.S.Corps of Engineers
14 to place"No-Wake" Buoys in Little Maumelle River subject to U. S. Coast Guard approval; and,
15 WHEREAS,the U. S. Coast Guard requires an ordinance specifying the City's desire to create a No-
16 Wake Zone on the Little Maumelle River; and,
17 WHEREAS, the Arkansas Game & Fish Commission is supportive and willing to enforce the
18 ordinance if City complies with requirements of Corps' Permit and Coast Guard's requirement for an
19 ordinance establishing a No-Wake Zone.
20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. Statement of Policy. The City of Little Rock, in order that safety is maintained for all
23 involved in this area, shall make it unlawful for an operator of any vessel to exceed a "slow, no-wake"
24 speed or otherwise create a hazardous wake on the following water bodies located in the City of Little Rock:
25 On the segment of the Little Maumelle River in Sections 15, 16 and 22, Township -2-N,
26 Range-13-West in Pulaski County, Arkansas.
27 A "Hazardous Wake" shall mean a wash or wake upon an approaching, passing, or stationary vessel,
28 including, but not limited to a wake that causes another vessel to take on water, or a wash or wake that is
29 sufficient to toss an occupant of another vessel about in a manner that can cause injury or the risk of injury.
30 Little Rock Parks and Recreation shall cause the affected area to be conspicuously marked as a"Slow,No
31 Wake"Zone.
32 Section 2. Violations. Violation of this ordinance shall be subject to punishment as set for in Section
33 1-9 of this Code.

1 Section 3. Severability. In the event any title, subtitle, section, subsection, subdivision, paragraph,
2 subparagraph, item,sentence,clause,phrase or word of this ordinance is declared to adjudged to be invalid
3 or unconstitutional,such declaration or adjudication shall not affect the remaining portions of this ordinance
4 which shall remain in full force and effect as if the portion so declared or adjudged invalid or
5 unconstitutional was not originally a part of this ordinance.
6 Section 4. Repealer. All ordinances,resolutions,or regulations,or any pats of such documents,which
7 are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
