HomeMy WebLinkAbout22019 1 ORDINANCE NO. 22,019 2 3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE 4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ENTER INTO AN 5 AGREEMENT WITH THE CENTRAL ARKANSAS LIBRARY SYSTEM, 6 IN AN AMOUNT NOT TO EXCEED SEVENTY-FIVE THOUSAND 7 DOLLARS, TO PROVIDE PROGRAMMING COORDINATION, 8 MEETINGS AND APPLICATIONS FOR THE BE MIGHTY SUMMER 9 MEALS PROGRAM; AND FOR OTHER PURPOSES. 10 11 WHEREAS, in 2019 the Be Mighty Program,to reduce hunger in the Little Rock community, and to 12 expand participation in such a program, was funded by the National League of Cities("NLC")and carried 13 out by the Central Arkansas Library System ("CALS"); and, 14 WHEREAS, it was determined to continue this program in 2020 with funds provided by the City of 15 Little Rock,Arkansas("the City"),and again to use CALS for the programming,coordination,meeting and 16 application for such programs; and, 17 WHEREAS,the data that CALS has gathered,the efforts it has taken and intend to take to extend the 18 participation in this program and the steps it is already prepared to take to extend this program further so 19 that more locations and more people will participate in the program; and, 20 WHEREAS,the loss of data compilation and of the experience that CALS has gathered makes it im- 21 practical and unfeasible to subject this program to a competitive selection process. 22 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 23 OF LITTLE ROCK,ARKANSAS: 24 Section 1. The Board of Directors declares that it is impractical and unfeasible to subject to Be Mighty 25 Program for 2021 to a competitive selection process since to do so could cause of loss of data compiled, 26 and experience gained, by CALS since 2019. 27 Section 2. The City Manager is authorized to enter into an agreement with CALS, in an amount not 28 to exceed Seventy-Five Thousand Dollars($75,000.00)to provide coordination of programming,meetings, 29 and the application of a Summer Meals Program. 30 Section 3. Funds for this agreement are available in Account No. 108159-S 15C321. 31 Section 4. Absent a change in circumstances, law, or legislation, which would make it practical and 32 feasible to submit this agreement to a competitive selection process,the City Manager has the authority to 33 grant a contract extension for 2022,and a potential second contract extension for 2023,at the same amount 34 of as provided in this ordinance [Page 1 of 2] 1 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 2 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 3 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 4 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 5 ordinance. 6 Section 6. Repealer. All resolutions, bylaws, and other matters inconsistent with this ordinance are 7 hereby repealed to the extent of such inconsistency. 8 Section 7. Emergency Clause. The necessity to operate competent and effective feeding programs to 9 reduce hunger within the City is essential to the public health, safety, and welfare; an emergency; 10 therefore, is declared to exist and this ordinance shall be in full force and effect from and after the date of 11 its passage. 12 PASSED: August 3,2021 13 ATT .
