3 A RESOLUTION TO AUTHORIZE THE MAYOR OF THE CITY OF
4 LITTLE ROCK,ARKANSAS,TO ACCEPT FOR MUNICIPAL PURPOSES
5 PERMANENT, CONSTRUCTION EASEMENTS, RIGHT-OF-WAY
6 DEDICATIONS AND FEE SIMPLE ACQUISITIONS; TO AUTHORIZE
7 THE CITY MANAGER TO ACQUIRE TEMPORARY CONSTRUCTION
8 EASEMENTS AS NEEDED TO COMPLETE THE CONSTRUCTION OF
9 THE SOUTHEAST TRAIL PROJECT; AND FOR OTHER PURPOSES.

11 WHEREAS, the Little Rock Board of Directors has received a Transportation Alternative Project
12 Grant for the construction of a portion of the Southeast Trail,east of Heifer International to be constructed
13 as an extension of the Arkansas River Trail;and,
14 WHEREAS,the acquisition of Easements, Right-of-Way, and Fee Simple Acquisitions is needed to
15 accomplish the construction,maintenance and continued access of the trail improvements.
16 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS:
18 Section 1. The City Manager is authorized to pursue the acquisition of Permanent Construction
19 Easements, Right-of-Way Dedications, Fee Simple Acquisitions and Temporary Construction Easements
20 as need to complete the Southeast Trail Project,as authorized by Resolution No. 15,126.
21 Section 2. The Mayor is authorized to accept Permanent Construction Easements, Right-of-Way
22 Dedications and Fee Simple Acquisitions for municipal purposes and the City Manager is authorized to
23 accept Temporary Construction Easements needed for construction.
24 Section 3. Funding for acquisition of easements and dedications is from a Street Fund Special Project
25 activity for the project.
26 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
27 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
28 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
29 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
30 resolution.
31 Section 5. Repealer.All laws, ordinances,resolutions,or parts of the same,that are inconsistent with
32 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
