3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO
4 ENTER INTO AN AGREEMENT WITH TODAY'S POWER, INC., FOR
5 THE SALE OF APPROXIMATELY EIGHTY (80) ACRES OF LAND
6 LOCATED IN THE CITY OF LITTLE ROCK, PULASKI COUNTY,
7 ARKANSAS, BY THE CITY OF LITTLE ROCK, ARKANSAS, FOR THE
8 BENEFIT OF THE LITTLE ROCK PORT AUTHORITY; AND FOR
9 OTHER PURPOSES.

11 WHEREAS, the Little Rock Port Authority markets land for economic development purposes and
12 encourages industry to locate at the Port of Little Rock; and,
13 WHEREAS,the Little Rock Port Authority recently developed a Master Growth Plan that identified
14 various industry segments that would be good industry partners;and,
15 WHEREAS, Today's Power, Inc., has approached the Little Rock Port Authority about buying
16 approximately eighty(80)acres of land located on Frazier Pike Road to construct a solar facility; and,
17 WHEREAS, the land in question is not suitable for traditional development but will easily
18 accommodate this planned use.
19 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
20 LITTLE ROCK PORT AUTHORITY:
21 Section 1. The Little Rock City Board of Directors authorize the Mayor and City Clerk to enter into a
22 Real Estate Contract to sell approximately eighty(80)acres of land located on Frazier Pike Road to Today's
23 Power, Inc., Dakota Investments, Inc. for Two Hundred Seventy-Seven Thousand, Five Hundred Dollars
24 ($277,500.00)for Parcel No. 24R0290000100, which is more particularly described as:
25 THE NE 'A NW 'A AND THE SE 'A NW 1/4, SECTION 29, T-1-N, R-11-W, PULASKI
26 COUNTY,ARKANSAS CONTAINING 80.36 ACRES MORE OR LESS.
27 Section 2. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph,
28 item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or
29 unconstitutional, such declaration or adjudication shall not affect the remaining portions of this resolution,
30 which shall remain in full force and effect as if the portion so declared or adjudged invalid or
31 unconstitutional were not originally a part of this resolution.
32 Section 3. Repealer.All laws ordinances resolutions or parts of the same that are inconsistent with the
33 provisions of this resolution are hereby repealed to the extent of such inconsistency
