3 AN ORDINANCE TO APPROVE THE ACTION OF THE LT. WALTER E.
4 PARKER VETERANS OF FOREIGN WARS POST 1316, LOCATED AT
5 2304 SOUTH ARCH STREET LITTLE ROCK, ARKANSAS, IN FILING
6 AN APPLICATION FOR OPERATION AS A PRIVATE CLUB
7 PERMITTED FROM THE ARKANSAS ALCOHOL BEVERAGE
8 CONTROL DIVISION OF THE ARKANSAS DEPARTMENT OF
9 FINANCE AND ADMINISTRATION; TO COMPLY WITH ARK. CODE
10 ANN. § 3-9-222(a)(1); TO DECLARE AN EMERGENCY; AND FOR
11 OTHER PURPOSES.

13 WHEREAS,the Lt.Walter E.Parker Veterans of Foreign Wars Post 1316("VFW Post 1316"),located
14 at 2304 South Arch Street, Little Rock, Arkansas, 72206, seeks to obtain a permit to operate as a private
15 club in compliance with the Arkansas Beverage Control Division ("ABC") Rules and Regulations and
16 Arkansas Statutes; and,
17 WHEREAS,such a use for this property is within the exclusive jurisdiction of,and has been approved
18 by,the Capitol Zoning Commission; and,
19 WHEREAS, Act 1112 of 2017, codified at Ark. Code Ann. § 3-9-222(a)(1), as may be amended,
20 requires applicants for a Private Club License obtain approval of the governing body of the city or county
21 where the private club is to be located to follow the statutory process.
22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK,ARKANSAS:
24 Section 1. Pursuant to Act 1112 of 2017, as may be amended, the City of Little Rock, Arkansas,
25 approves the action of the Lt. Walter E. Parker Veterans of Foreign Wars Post 1316 to follow the statutory
26 process to file a Private Club Application with the Department of Finance and Administration, Alcoholic
27 Beverage Control Division,for the location at 2304 South Arch Street, Little Rock, Arkansas, 72206.
28 Section 2. A copy of this ordinance may be provided to the ABC Division of the Arkansas Department
29 of Finance and Administration as evidence that the City Governing Body has authorized such a use within
30 this zoning classification.
31 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
32 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
33 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and

1 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
2 ordinance.
3 Section 4. Repealer. All resolutions, bylaws, and other matters inconsistent with this ordinance are
4 hereby repealed to the extent of such inconsistency.
5 Section 5. Emergency Clause. The necessity of appropriate procedures to follow in order to obtain
6 a permit for the sale of alcoholic beverages that complies with state statutes and regulations, and which
7 is stated in a way acceptable to the ABC is essential to the public health, safety and welfare, because it
8 provides a means for the ABC to undertake its appropriate enforcement, administrative,permitting duties;
9 this ordinance cannot proceed until such language is in place; therefore, an emergency declared to exist
10 and this ordinance shall be in full force and effect from and after the date of its passage.
