HomeMy WebLinkAbout21989 1 ORDINANCE NO. 21,989 2 3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE 4 TO BID; TO AUTHORIZE THE CITY MANAGER TO EXECUTE A 5 SOLE-SOURCE AGREEMENT WITH SOUTHWESTERN BELL 6 TELEPHONE COMPANY, D/B/A AT&T ARKANSAS, FOR THE AT&T 7 HOSTED VESTA 911 SERVICE TELEPHONE UPGRADE AND AT&T 8 MAINTENANCE FOR THESE SERVICES; TO DECLARE AN 9 EMERGENCY; AND FOR OTHER PURPOSES. 10 11 WHEREAS, the current 911 telephone equipment in use by the City of Little Rock, Arkansas, is a 12 Motorola VESTA Call Handling System, Version 4.3. The current version of VESTA being tested in 13 AT&T Labs is Version 7.7; and, 14 WHEREAS, to upgrade the City's current 911 Telephone System to Version 7.7 would require 15 incremental upgrades to multiple versions prior to reaching Version 7; and, 16 WHEREAS, it is impossible to go straight from Version 4.3 to Version 7.7,as there is not a feasible, 17 cost effective solution for those individual upgrades without a complete system hardware/software 18 replacement;and, 19 WHEREAS, the AT&T Hosted VESTA 911 Service is a product, sold and distributed by only 20 AT&T Arkansas and no other item is available for purchase that would serve the same purpose or 21 function; and, 22 WHEREAS, the purchase of the AT&T Hosted VESTA 911 Service will provide the City with a 23 NexGen911 service capable of interoperability and guaranteed to receive consistent software upgrades. 24 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 25 OF LITTLE ROCK,ARKANSAS: 26 Section 1. The Board of Directors declares that it is impractical and unfeasible to submit the 27 upgrade and associated maintenance of the City's 911 Telephone System to a competitive bid process, 28 and,therefore,waives competitive bidding. 29 Section 2. The City Manager is hereby authorized to execute a Sole-Source Agreement with 30 Southwestern Bell Telephone Company, d/b/a AT&T Arkansas, for the AT&T Hosted VESTA 911 31 Service telephone upgrade for a total upfront amount not to exceed Seven Hundred Thousand Dollars 32 ($700,000.00), and for an amount not to exceed Twelve Thousand, Five Hundred Dollars ($12,500.00) 33 per month for AT&T maintenance for these services,plus any applicable taxes and fees. [Page 1 of 2] • 1 Section 3. Funding is available from the 91 1 Wireless Fund Account,Account No. 220512-63375. 2 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 3 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 4 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 5 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 6 ordinance. 7 Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with 8 any provision of this ordinance are hereby repealed to the extent of such conflict. 9 Section 6. Emergency Clause. The need for an immediate, uninterrupted and updated 911 10 Telephone System and maintenance services for this system is necessary to protect the City's critical 911 11 Dispatch System for essential city services, and, therefore, is crucial to protect the public health, safety 12 and welfare; an emergency is, therefore, declared to exist and this ordinance shall be in full force and 13 effect from and after the date of its passage. 14 ADOPTED: May 4,2021 15 ATTEST: APPROVED: 16 • 7 18 usan ley, Clerk Frank Scotta 19 APPRO D ASLEGALFORM: TO 20 / 2167/114'111-ti . 22 Thomas M.
