HomeMy WebLinkAbout15445 1 RESOLUTION NO. 15,445 2 3 A RESOLUTION TO DECLARE THE EXTENSION OF A LOCAL 4 DISASTER EMERGENCY AS A RESULT OF THE COVID-19 5 PANDEMIC; AND FOR OTHER PURPOSES. 6 7 WHEREAS, on March 11, 2020, Mayor Frank Scott, Jr., issued an Emergency Proclamation stating 8 that the City of Little Rock,Arkansas,was in an emergency situation as a result of the COVID-19 Pandemic 9 ("the Pandemic");and, 10 WHEREAS,on March 26,2020,because of the Pandemic,Mayor Scott issued the first Declaration of 11 Local Disaster Emergency which formally declared a Local Disaster Emergency pursuant to Ark. Code 12 Aim. § 12-75-108 which continued for 120 days until July 24,2020 and then ended; and, 13 WHEREAS,on August 21,2020,because of the Pandemic,Mayor Scott issued Declaration of Local 14 Disaster Emergency No.20-07 pursuant to Arkansas State Law which continued until December 19,2020, 15 and then ended;and, 16 WHEREAS, on December 29, 2020, because of the Pandemic, Mayor Scott issued Declaration of 17 Local Disaster Emergency No.20-08 pursuant to Arkansas State Law which would continue until April 28, 18 2021,unless extended by action of the Board of Directors;and, 19 WHEREAS,the emergence of a vaccine for COVID-19 has helped to dramatically lower the number 20 of infections,as well as the number of new cases;however,there is still a need for some actions during the 21 next few months to assure that there is not a surge in new infections caused by the original strain or by any 22 of the more recently identified strains of COVID-19. 23 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 24 LIF LITTLE ROCK,ARKANSAS: 25 Section 1. Pursuant to the authority granted to the Governing Body of a Municipality in Ark. Code 26 Ann.§ 12-75-108(a)(3),the Mayor of the City of Little Rock,Arkansas,is authorized to continue in effect 27 for four(4)months,or until August 31,2021,Declaration of Local Disaster Emergency 21-01 for the City 28 of Little Rock, Arkansas, and to take such actions as deemed necessary to address issues created by the 29 pandemic provided that there is compliance with the provisions of this resolution. 30 Section 2. At the second regular meeting of the Board of Directors, the question of whether to 31 continue Declaration of Local Disaster Emergency No. 21-01 shall be considered, and if a majority of the 32 members of the Board vote against continuation then the Declaration shall cease immediately. 33 Section 3. Nothing in this resolution prohibits the Mayor from unilaterally declaring that Declaration 34 of Local Disaster Emergency No.21-01 is no longer in effect if between the annual monthly review during 35 the second regular meeting of the Board of Directors, and the first regular meeting the next month, 36 conditions and circumstances demonstrate that the continuation of the Declaration is no longer required. In the event any title,paragraph, item,sentence,clause,phrase,or word of this 2 resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall 3 not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion 4 so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. 5 Section 5. Repealer.
