3 AN ORDINANCE TO ABANDON A SANITARY SEWER EASEMENT
4 LOCATED WITHIN THE PROPERTY AT 16801 CHENAL PARKWAY,
5 IN THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER
6 PURPOSES.

8 WHEREAS, a request was made by Costco Wholesale Corporation to abandon the Sanitary Sewer
9 Easement located within the property at 16801 Chenal Parkway, (the "Chenal Property") Little Rock,
10 Arkansas, under the City's General Police Power Authority pursuant to Ark. Code Ann. § 14-54-104; and,
11 WHEREAS, the Chenal Property is in the process of being developed for a new retail business with
12 outparcels and as part of the development new sewer mains were installed to reroute the old sewer main;
13 and,
14 WHEREAS, the Little Rock Water Reclamation Authority has approved the proposed Sanitary
15 Sewer Easement abandonment; and,
16 WHEREAS,abandoning this Chenal Property Sanitary Sewer Easement will have no adverse impact
17 on the public welfare and safety;
18 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
19 OF LITTLE ROCK,ARKANSAS:
20 Section 1. The Board of Directors hereby releases, vacates,and abandons a Sanitary Sewer Easement
21 located within the property at 16801 Chenal Parkway, Little Rock, Pulaski County, Arkansas, being more
22 particularly described as follows:
23 G-23-059: Being known as a portion of a ten (10)-foot right-of-way easement dedicated in
24 Instrument No. 94-36052 and Instrument No. 94-51434 to be abandoned. More
25 particularly described as the northerly 433.40 feet of said easement, less and except that
26 portion lying within the right-of-way of Chenal Parkway, 285.58 feet immediately south of
27 the southerly right of way of Chenal Parkway, and containing 2,857 square-feet, more or
28 less.
29 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the Real Estate
30 Records of the Recorder of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas.
31 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
32 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
33 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and

1 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
2 of the ordinance.
3 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
4 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
