3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., RESOLUTION
4 15,015 (JUNE 18, 2019), TO INCREASE THE CONTRACT WITH BEN
5 NELSEN GOLF AND UTILITY VEHICLES BY TWENTY-NINE
6 THOUSAND DOLLARS ($29,000.00), TO LEASE AN ADDITIONAL
7 FIFTEEN (15) GOLF CARTS FOR THE REBSAMEN GOLF COURSE;
8 AND FOR OTHER PURPOSES.

10 WHEREAS, in Little Rock, Ark., Resolution No. 15,015 (June 18, 2019), the Board of Directors
11 authorized the Parks & Recreation Department to enter into a Sole-Source Contact with Ben Nelsen Golf
12 and Utility Vehicles for the leasing of seventy-seven(77)Electric(lithium-ion)Golf Carts at an annual cost
13 of One Hundred Forty-Six Thousand,Two Hundred Eighty-Two and 40/100 Dollars($146,282.40); and,
14 WHEREAS, Resolution No. 15,015 provided for a one (1)-year lease term beginning July 16, 2019,
15 with three(3)additional one(1)-year terms ending July 15, 2023; and,
16 WHEREAS, it was the intent of the Board of Directors to allow additional leases of Golf Carts from
17 Ben Nelsen Golf and Utility Vehicles under the above-referenced contract while the balance of the contract
18 is still in effect;and,
19 WHEREAS, any additional leases to the above-referenced contract while the balance of the contract
20 is still in effect may be made by resolution in the future; and,
21 WHEREAS, the ongoing COVID-19 Pandemic mandated operating changes to ensure customer
22 safety, and Rebsamen Golf Course currently allows one (1)-rider per cart, which creates a shortage of
23 available carts with potential loss in revenue; and,
24 WHEREAS,the Parks and Recreation Department requests to amend Resolution No. 15,015 to add an
25 additional fifteen(15)Golf Carts to the Lease with Ben Nelsen Golf and Utility Vehicles until two(2)riders
26 per cart is allowed.
27 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
28 OF LITTLE ROCK,ARKANSAS:
29 Section 1. Little Rock,Ark., Resolution No. 15,015 (June 18, 2019)is amended to increase the lease
30 contract cost with Ben Nelsen Golf and Utility Vehicles by Twenty-Nine Thousand Dollars ($29,000.00)
31 to include an additional fifteen(15)Golf Carts per month.
32 Section 2. The total contact shall be amended to increase from One Hundred Forty-Six Thousand,
33 Two Hundred Eighty-Two and 40/100 Dollars ($146,282.40), to One Hundred Seventy-One Thousand,
34 Two Hundred Eighty-Two and 40/100 Dollars($171,282.40).

1 Section 3. Any additional leases of Golf Carts from Ben Nelsen Golf and Utility Vehicles while the
2 balance of the contract which began on July 16, 2019, with three (3) additional one(1)-year terms ending
3 July 15,2023, is still in effect may be made by means of a Little Rock, Ark., Resolution.
4 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
5 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
6 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
7 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
8 ordinance.
9 Section 5. Repealer. All laws,ordinances, resolutions,or parts of the same,that are inconsistent with
10 the provisions of this ordinance, are hereby repealed to the extent of such inconsistency including, but not
11 limited to, Little Rock,Ark., Resolution No. 15,015 (June 18, 2019).
