HomeMy WebLinkAbout21970 1 ORDINANCE NO. 21,970 2 3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., ORDINANCE NO. 4 21,891 (JULY 21, 2020) TO INCLUDE FEES PAYABLE TO WASTE 5 MANAGEMENT OF ARKANSAS FOR ADDITIONAL CURBSIDE 6 RECYCLING CONTAINERS PROVIDED AT REQUEST OF LITTLE 7 ROCK RESIDENTS; TO DECLARE AN EMERGENCY; AND FOR 8 OTHER PURPOSES. 9 10 WHEREAS, Little Rock, Ark., Ordinance No. 21,891 (July 21, 2020), provided for per month per 11 residential customer fees for services, but did not include the fees for each additional Recycling Container 12 provided by Waste Management to a Residential Unit at that unit's request; and, 13 WHEREAS, it is necessary to amend Ordinance No. 21,891 to clarify the long-standing requirement 14 for such payment to Waste Management for each additional Recycling Container provided by Waste 15 Management to a Residential Unit at that unit's request. 16 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 17 OF LITTLE ROCK,ARKANSAS: 18 Section 1. Ordinance No. 21,891 is hereby amended to authorize the Mayor and City Manager to 19 enter into an extension of the existing Curbside Recycling Agreement with Waste Management through 20 March 31, 2024 for Waste Management to provide Curbside Recycling for approximately 60,000 Solid 21 Waste Customers, at a cost of: 22 (a) Four and 90/100 Dollars ($4.90) per month per residential customer for April 1, 2021, 23 through March 31, 2022, and an additional Three Dollars ($3.00) for each additional 24 Recycling Container provided by Waste Management to a Residential Unit at that unit's 25 request; and, 26 (b) Five and 07/100 Dollars ($5.07) per month per residential customer for April 1, 2022, 27 through March 31, 2023, and an additional Three and 11/100 Dollars ($3.11) for each 28 additional Recycling Container provided by Waste Management to a Residential Unit at that 29 unit's request; and, 30 (c) Five and 25/100 Dollars ($5.25) per month per residential customer for April 1, 2023, 31 through March 31, 2024, and an additional Three and 22/100 Dollars ($3.22) for each 32 additional Recycling Container provided by Waste Management to a Residential Unit at that 33 unit's request. Page 1 of 21 1 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 2 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 3 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 5 ordinance. 6 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 7 with the provisions of this ordinance, are hereby repealed to the extent of such inconsistency, including, 8 but not limited to Ordinance No. 21,891. 9 Section 4. Emergency Clause.
