'j- �' ` PRESENTED 03-18-2021 Q9'.??21.4M RECORDED:03-18-2021 09:17:21 AM 4 yt... d W :E Li ;+, la"14 si c In Official Records of Tern Hollingsworth Circuit/County Clerk r= '' 2= ORDINANCE NO. 21 9 q Y 1 why J rt7LASKl CO,AR FEE $20 00 Jb3g NOV 3 ''"f11,AIW"ORDINANCE ADOPTED PURSUANT TO ACT 1112 OF 2017 4 APPROVING THE FILING OF AN APPLICATION BY LA ARANDAS 5 TAQUERIA, INC., LOCATED AT 4721 BASELINE ROAD, SUITES C, D, 6 AND E, LITTLE ROCK, PULASKI COUNTY, ARKANSAS, FOR 7 OPERATION AS A PRIVATE CLUB PERMIT FROM THE ARKANSAS 8 ALCOHOL BEVERAGE CONTROL DIVISION OF THE ARKANSAS 9 DEPARTMENT OF FINANCE AND ADMINISTRATION; TO DECLARE 10 AN EMERGENCY; AND, FOR OTHER PURPOSES. 11 12 WHEREAS,Act 1112 of 2017,at Ark.Code Ann. §3-9-222(a)(1),as may be amended,requires that 13 applicants for a Private Club License obtain approval of the governing body of the City or County where 14 the private club is to be located; and, 15 WHEREAS, pursuant to Little Rock, Ark., Ordinance No. 21,954 (January 19, 2021), La Arandas 16 Taqueria, Inc., obtained a Planned Commercial Development (PCD) zoning classification which, among 17 other things, would permit a private club, as defined in Ark. Code Ann. §13-9-202, to operate at 4721 18 Baseline Road, Little Rock, Arkansas, upon approval of the Arkansas Beverage Control Division (ABC) 19 rules and regulations,and Arkansas Statutes; and, 20 WHEREAS,notwithstanding the statement that the name of the PCD—La Arandas Taqueria Private 21 Club PCD -- was intended to assure all regulatory entities that the governing body of the City of Little 22 Rock,Arkansas("the City")had approved a private club use in this specific PCD,the ABC wishes language 23 which more positively asserts and clarifies that the Board of Directors of the City has considered the 24 application of La Arandas Taqueria,Inc.,and finds the location of the private club,as defined in Ark.Code. 25 Ann §13-9-202, is in a qualified zone. 26 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 27 OF LITTLE ROCK,ARKANSAS: 28 Section 1. Pursuant to Act 1112 of 2017,as may be amended, La Arandas Taqueria,Inc.,as set forth 29 in Little Rock, Arkansas, Ordinance No. 21,954 (January 19, 2021) is authorized to file a private club 30 application with the Department of Finance and Administration,Alcoholic Beverage Control Division,for 31 the location at 4721 Baseline Road, Suites C, D, and E. Little Rock, Pulaski County,Arkansas. 32 Section 2.A copy of this ordinance may be provided to the ABC Division of the Arkansas Department 33 of Finance and Administration as evidence the City governing body has authorized such a use within this 34 zoning classification. [Page 1 of 21 1 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 2 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 3 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 4 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 5 ordinance. 6 Section 4. Repealer. All resolutions, bylaws, and other matters inconsistent with this ordinance are 7 hereby repealed to the extent of such inconsistency including, but not limited to, Little Rock, Ark., 8 Ordinance No.21,954(January 19,2021). 9 Section 5. Emergency Clause.
