3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REVISED CODE
4 CHAPTER 13, ARTICLE II, DIVISION 3, § 13-60 (1988), TO ADOPT AND
5 ENFORCE A ONE (1)-FOOT FREEBOARD REQUIREMENT FOR
6 MACHINERY AND EQUIPMENT FOR ALL RESIDENTIAL BUILDINGS
7 CONSTRUCTED, SUBSTANTIALLY IMPROVED, AND/OR
8 RECONSTRUCTED DUE TO SUBSTANTIAL DAMAGE THROUGHOUT
9 THE SPECIAL FLOOD HAZARD AREAS OF THE CITY OF LITTLE
10 ROCK; AND FOR OTHER PURPOSES.

12 WHEREAS, the City of Little Rock, Arkansas, is a participant in the Community Rating System
13 (CRS), which is a voluntary program that provides Flood Insurance premium discounts to communities
14 that implement programs and measures that exceed the minimum floodplain management requirements of
15 the National Flood Insurance Program. The CRS determines discounts based on credit points provided
16 for floodplain management activities which is applied to citizen's insurance premiums; and,
17 WHEREAS, on January 1, 2021, CRS implemented a new Class 8 prerequisite for freeboard for all
18 participating and new CRS communities; and,
19 WHEREAS, in order to maintain a Class 8 or better community in CRS,the City of Little Rock must
20 adopt and enforce at least a one (1)-foot freeboard requirement, including machinery and equipment, for
21 all residential buildings constructed, substantially improved, and/or reconstructed due to substantial
22 damage throughout the Special Flood Hazard Area where base flood elevations have been determined on
23 the Flood Insurance Rate Map or in the Flood Insurance Study,except those areas that receive open space
24 credit under Activity 420(Open Space Preservation).
25 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
26 CITY OF LITTLE ROCK,ARKANSAS:
27 Section 1. Chapter 13 of the City of Little Rock Municipal Code of Ordinances,Article II, Division 3,
28 Section 13-60, (1), (a) is hereby repealed and replaced with the following new provision for residential
29 structures in AE or A1-30 zones:
30 (1) For all new residential structures, the top surface of the lowest floor(including all machinery
31 and equipment)must have an elevation at least one(1)foot or more above the published Base
32 Flood Elevation (BFE). This elevation must be documented on an Elevation Certificate
33 properly completed by a Professional Engineer, Surveyor or Architect licensed to practice in
34 the State of Arkansas.

1 Section 2. Chapter 13 of the City of Little Rock Municipal Code of Ordinances, Article II, Division
2 3, Section 13-60, (1),(c) is hereby amended with the following new provision for manufactured homes in
3 zones AE or A1-30:
4 (5) All machinery and equipment shall be elevated to at least one (1)-foot or more above the
5 published BFE and be securely anchored to resist flotation, collapse, and lateral movement.
6 This elevation must be documented on an Elevation Certificate properly completed by a
7 Professional Engineer, Surveyor or Architect licensed to practice in the State of Arkansas.
8 Section 3. Chapter 13 of the City of Little Rock Municipal Code of Ordinances, Article II, Division
9 3, Section 13-60, (3), (a) is hereby repealed and replaced with the following new provision for residential
10 structures in AH or AO zones:
11 (1) For all new residential structures, the top surface of the lowest floor(including all machinery
12 and equipment) must have an elevation at least one (1)-foot or more above the published
13 BFE, or at least one(1)-foot or more above the highest adjacent grade in addition to the depth
14 number specified (at least two (2) feet if no depth number is specified) on the community's
15 Flood Insurance Rate Map. This elevation must be documented on an Elevation Certificate
16 properly completed by a Professional Engineer, Surveyor or Architect licensed to practice in
17 the State of Arkansas.
18 Section 4.Chapter 13 of the City of Little Rock Municipal Code of Ordinances,Article II, Division 3,
19 Section 13-60, (4), (a) is hereby repealed and replaced with the following new provision for residential
20 structures in A risk zones with no base flood elevations determined:
21 (1) For all new residential structures,the top surface of the lowest floor(including all machinery
22 and equipment) must have an elevation at least one (1)-foot or more above the BFE. This
23 elevation must be documented on an Elevation Certificate properly completed by a
24 Professional Engineer, Surveyor or Architect licensed to practice in the State of Arkansas.
25 Section 5. Chapter 13 of the City of Little Rock Municipal Code of Ordinances, Article II, Division
26 3, Section,Section 13-60, (4), (d) is hereby amended with the following new provision for manufactured
27 homes in A Zones:
28 (5)All machinery and equipment shall be elevated to at least one(1)-foot or more above the BFE
29 and be securely anchored to resist flotation, collapse, and lateral movement. This elevation
30 must be documented on an Elevation Certificate properly completed by a Professional
31 Engineer, Surveyor or Architect licensed to practice in the State of Arkansas.
32 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
33 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
34 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
35 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the

2 Section 7. Repealer. All laws,ordinances,resolutions,or parts of the same,that are inconsistent with the
3 provisions of this resolution are hereby repealed to the extent of such inconsistency.
