You deferred last night till March 9, 2020. A withdrawal means ending that application without a vote for approval or denial. A deferral allows you to change the design while still keeping it a multi-family structure. We call it multifamily even though it will be condos. The legal ad states multifamily and a PRD, so as long as it stays within that parameter, you can keep with the same item. This is what you have done with the expectation that there will be revisions to the design with communication between you and the neighborhood. At the March hearing, whether it is revised or not, you the applicant have three choices; ask for a vote to approve, defer, or withdraw. If you have revised all you can or think you have an approval able design, you may want the up or down vote to approve or reject. If there are some tweaks that could still be made that you feel would get you a positive vote for approval, then defer, edit, and come back for a final vote. If you feel that this will not go anywhere or just want to step back and consider your options, ask for a withdrawal. A withdrawal means ending that application without a vote for approval or denial. If you withdraw, you cannot apply again for one year with an application that is substantially the same as the last one. The commission at that time decides if it is substantially different or not. Different amounts of floors, different site plan, different wall materials, etc., would be considered to see if it was substantially different enough. A new application can come before the HDC DRC for that pre-application meeting. The commission has typically not allowed for two options to be reviewed at the same time. if it was substantially different, that would be more of a case to do so. But variations on a theme, we have not done so. I hope that clears this up. We asked last night about the difference between deferral and withdrawal and are still not sure. After last night we are looking at options and believe we will be making enough changes that we are unsure if we should maintain our deferral or go ahead and withdraw. My first question is how do we understand if we need to be changing to a deferral or stay with a withdrawal situation. My second question is what is the difference between deferral and withdrawal. (I thought I heard that we get another shot at the DRC with withdrawal.) My third question is can a person submit 2 projects for the same property at the same time.
