RE: Proposed Land Use Amendment and Rezoning
Land Adjacent to Cantrell Heights Shopping Center
Dear Mr. Moore:
Cantrell Heights shopping center is a commercial real estate property located at 8122 to
8218 Cantrell Road. This property is on the north side of Cantrell Road, directly across
Cantrell Road from Pavilion in the Park and Pavilion Centre. This letter accompanies
applications from the property owners requesting a change in the Land Use Plan and a
change in the Zoning Plan to allow for the expansion of Cantrell Heights Shopping Center.
The owners of Cantrell Heights own a vacant lot and three houses immediately to the
west. These houses all face Cantrell Road / Highway Ten and are rented to provide
investment income. Expansion of Cantrell Heights to the west would replace these houses
that were built in the 1940s, when this area was still a quiet country road referred to as
Perryville Road, with a use of the property that recognizes the changes that have come
with office buildings and shopping centers being built across the road, and the country
road becoming a five -lane urban highway,
The proposal for rezoning of this property is to allow the center to be expanded to provide
better circulation and access to the existing buildings and parking lot. Such expansion
would include additional restaurant, retail, office and other uses common to
neighborhood shopping centers. Cantrell Heights is zoned C-3 and it is the owners' desire
to continue the C-3 zoning to the west and maintain continuity in the zoning of the
extended center. Cantrell Heights was completed in 1976 and has served the surrounding
community since before growth of the retail, office & commercial uses across the highway.
Cantrell Heights has been, and will continue to be, a good fit in the neighborhood. The
topography of the land provides a natural barrier between the proposed extension of the
center and the residential properties to the north. Surrounding land uses include office
buildings, shopping centers, apartment buildings, condos, the Racquet Club, and Reservoir

Park. All of these uses have co -existed for years. Pavilion Centre office building to the
west of Cantrell Heights and directly across the highway from the proposed rezoning is
the most recent addition. In summary, the proposed rezoning is consistent with the land
use and zoning of the surrounding properties. It increases density rather than promoting
sprawl. It recognizes that the highest and best use of the property has changed as the
highway and surrounding properties have changed. And it may directly impact only one
residence. That residence, at 8308 Cantrell Rd., and two others at 8330 and 8350 Cantrell
sit across from Reservoir Park and just east of the gated entry to Ridgeview Dr. These
homes already endure the traffic on Highway Ten of over 31,000 cars per day. The
orientation of the properties provides that the required landscape buffers & building
setbacks allow for appropriate screening between the rezoned property and those houses.
The requested rezoning is not speculative; it is for the expansion and improved parking &
circulation of Cantrell Heights. Construction of new building(s) however will be demand -
driven and the full completion of this expansion may be years in the making. The owners
desire the expansion to provide access and circulation of traffic within the center. They
anticipate future western driveway(s) of the expansion will match the entrance to
Reservoir Park or the entrance to Pavilion Centre. This will allow better access to the
parking field in the rear of Cantrell Heights & will provide the expansion with access to the
existing traffic signal at the intersection of Andover Court that serves Pavilion in the Park
and other businesses. Existing businesses in Cantrell Heights will benefit from improved
access as will future businesses in new building(s) on the land proposed for rezoning.
A copy of the bill of assurance from 1925 was being located. It does not restrict current or
future uses. All necessary right-of-way dedications and street improvements appear to
have been made at the time this property was developed or during various widenings of
Highway Ten over the years. The property owner has submitted the necessary forms for
the dedication of additional right-of-way in the event that any is necessary.
