A RESOLUTION TO AUTHORIZE THE MAYOR AND THE
CITY CLERK TO EXECUTE A CORRECTION DEED NEEDED
TO CONVEY CERTAIN UNNEEDED RIGHT -OF -WAY
LOCATED ALONG KANIS ROAD IN THE CITY OF LITTLE
ROCK, ARKANSAS TO BAPTIST HEALTH; AND FOR OTHER
PURPOSES.
WHEREAS, on June 7, 2005, the Board of Directors authorized the Mayor and
City Clerk to execute documents needed to convey certain unneeded right -of -way along
Kanis Road to Baptist Health in exchange for property deeded to the City by Baptist
Health when Kanis Road was realigned, and
WHEREAS, on June 14, 2005, the City provided a Quitclaim Deed to Baptist
Health to convey the subject property, and
WHEREAS, it has come to the City's attention that the legal description that was
supplied to the City for the resolution and deed is incorrect and must be corrected.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
20 Section 1. To properly effect the agreement about exchange of property

reached between Baptist Health and the City of Little Rock, the Mayor and City Clerk
are hereby authorized to execute a correction deed to correct the legal description to the
Quitclaim Deed from the City to Baptist Health, filed as Pulaski County No.
2005050810, and any other necessary documents to convey, in a form approved by the
City Attorney, right -of -way property along Kanis Road, as described in Attactollfil l
and shown on the map on Attachment B attached hereto, to Baptist Health. !V

Section 2. Severability. In the event any title, section, paragraph, item, sentence,
clause, phrase, or word of this resolution is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the resolution which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional were not originally a part of the
resolution.
Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that
are inconsistent with the provisions of this resolution, are hereby repealed to the extent
of such inconsistency.
