3 PETITION FROM THE BOARD OF DIRECTORS TO THE
4 ALCOHOLIC BEVERAGE CONTROL ADMINISTRATION
5 DIRECTOR AND BOARD IN OPPOSITION TO THE CLASS B —5:00
6 A.M. PERMIT APPLICATION OF BRYAN KEITH STEWART FOR A
7 PRIVATE CLUB AT 300 S. UNIVERSITY, F01, LITTLE ROCK; AND
8 FOR OTHER PURPOSES.
9 WHEREAS, an application for a Class B -5:00 a.m. permit for 300 S. University,
10 F01 (University Mall), Little Rock has been filed with the Alcoholic Beverage Control
11 Division; and
12 WHEREAS, the Board of Directors of the City of Little Rock desires to oppose the
13 granting of this permit by the Alcoholic Beverage Control Division.
14 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
15 THE CITY OF LITTLE ROCK, ARKANSAS:
16 Section 1. The Board of Directors is hereby authorized to execute a petition in
17 opposition to the permit application for the reasons stated therein.
18 Section 2. This resolution will be in full force and effect from and after the date

6 IN OPPOSITION TO THE APPLICATION OF
7 BRYAN KEITH STEWART FOR A CLASS B -5:00 A.M. PERMIT
8 FOR ENVY RESTAURANT & LOUNGE, UNIVERSITY MALL
9 300 S. UNIVERSITY, F01, LITTLE ROCK, ARKANSAS
10 WHEREAS, Bryan Keith Stewart has filed an application for a Class B -5:00 a.m.
11 permit for 300 S. University, F01 (University Mall), Little Rock, Arkansas; and
12 WHEREAS, the Board of Directors of the City of Little Rock opposes the granting
13 of this permit by the Alcoholic Beverage Control Board for the reasons set forth below.
14 Issuance of the permit will not promote Public Convenience and Advantage
15 The issuance of the permit will not promote the public convenience and advantage:
16 (a) The area surrounding the premises at 300 University is adequately served by
17 established restaurants with liquor permits. (See attachment A- current permittees)
18 (b) The intersection of Markham and University is a high- traffic location that
19 already suffers a large number of accidents. See attachment B- accident statistics from
20 . The addition of a late night -early morning club nearby would likely increase
21 traffic and traffic accidents in the area, to the detriment of the general public.
22 (c) The proposed location is in the same mall with a business having tutoring
23 services for children, Pulaski County W.A.G.E. office for adult education, and the
24 federally funded Workforce Center which seeks to place qualified persons in jobs.
25 (d) The City of Little Rock is working diligently to improve the blighted
26 conditions in the mid -town area to promote economic revitalization and crime
27 reduction. A private club of this size and these hours does not fit the City's future
28 plans for quality Mid -Town Redevelopment.
I (e) The permit, if granted, would authorize the business to operate until 5:00
2 a.m. This conflicts with Little Rock, Ark. Rev. Code 4 -71 which provides for 7:00 a.m. -
3 2:00 a.m. Monday- Friday and Saturday from 7:00 a.m. to 1:00 a.m. the following Sunday
4 morning. The Board strongly believes that such earlier closing hours promote the
5 general public health and welfare by limiting drinking hours and persons who drive
6 while intoxicated and believe that a 5:00 a.m. closing hour operates to the detriment of
7 the general public.
