Dear Walter,
You make a good point. And when the issue comes up, Tony may wish to make that point
at the Board meeting. But, I do not believe that we are denying all investment backed
expectations for the property, i.e. a taking; we are merely saying that this particular
road as currently on the MSP will not be developed. This does not prevent someone from
coming in with a request to develop that property and show a road that it would like added
to the MSP at the time.
Now, I agree with you that if the City forever refused to do anything that could
allow for the development of the property, and totally precluded any alternative access to
the property, that it might create a problem. But, that is not the case. This action
simply says that this road as currently configured on the MSP will not be so configured.
Still, Tony may wish to bring out that point to Bruce and they can decide whether to
suggest it to the BOD. I was not provided the luxury of assuming that "any undeveloped
portion," did not mean just that.

I understand.
But the eastern segment will be hard to develop without a road in this corridor due to
topography and the current development pattern. It might make the land undevelopable - a
taking.
This is not about the western section connecting to Rahling Road. I am not sure that
everyone at the December meeting was aware there are two segments we are talking about.
Everyone was talking about the traffic etc due to connecting to Rahling, which is only
about the western segment not the eastern. But the eastern section will be at least
problematic with this wording.

Dear Walter,
I think my marching orders are to assure removal from the Master Street Plan and
that the road will not be developed. Director Cazort made the addition of all undeveloped
portions of the road. Since an amendment to the Master Street Plan could allow for the
development of a road in the future, if appropriate and approved by the Planning
Commission and not contrary to the various neighborhood concerns, then it would take
precedence. But, I think the Board really wanted pretty strong language on this one.
