HomeMy WebLinkAbout19367ORDINANCE NO. 19,367 2 3 AN ORDINANCE TO CONDEMN CERTAIN STRUCTURES IN 4 THE CITY OF LITTLE ROCK AS STRUCTURAL, FIRE AND HEALTH s HAZARDS; TO PROVIDE FOR SUMMARY ABATEMENT 6 PROCEDURES; TO DIRECT THE CITY ATTORNEY TO TAKE SUCH 7 ACTION AS IS NECESSARY TO RAZE AND REMOVE SAID 8 STRUCTURES; TO DECLARE AN EMERGENCY; AND FOR OTHER 9 PURPOSES. 10 11 WHEREAS, certain structures in the City of Little Rock, Arkansas, have become 12 run -down, dilapidated, unsightly, dangerous, obnoxious and detrimental to the public 13 welfare of the citizens of Little Rock; and 14 WHEREAS, the condition of these structures constitutes a serious structural, fire 15 and health hazard; and 16 WHEREAS, such structures are a public nuisance and are dangerous to the 17 health and safety of the occupants or other persons and, further, are in such condition as 18 to be dangerous to the lives, limbs and property of people in its vicinity or those 19 lawfully passing thereby; and 20 WHEREAS; such structures are declared a nuisance and immediate action is 21 necessary to remedy these situations and said buildings should be rehabilitated by the 22 owners or razed either by the owners or the City of Little Rock. 23 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 24 OF THE CITY OF LITTLE ROCK, ARKANSAS. 25 Section 1. The Board of Directors hereby declares that the following 26 structures constitute public nuisances. The owners of the following described [PAGE 1 OF 4] 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 properties are hereby ordered either to begin rehabilitation by immediately contacting the Department of Housing & Neighborhood Programs and entering into an agreement providing for the immediate rehabilitation of the structures or to raze and remove said structures within twenty -four (24) hours and to complete such removal within seventy - two (72) hours of the effective date of this Ordinance. While not required by law to do so, the Department of Housing & Neighborhood Programs will immediately attempt to notify the owners of the property listed below of the passage of this ordinance by certified mail or personal service. The conditions of the structures on the above - described property 35 have been found to present structural, fire and health hazards and are dangerous to the 36 health and safety of the occupants or other persons, and further, the structures are in [PAGE 3 OF 4] I such condition as to be dangerous to the lives, limbs and property of people in its 2 vicinity or those lawfully passing thereby. 3 Section 3. The City Attorney is hereby authorized to institute such 4 proceedings against such persons as may be necessary in order to enforce the provisions 5 of this ordinance so as to remedy the unsightly and dangerous conditions brought 6 about as a result of the failure of the owners thereof to maintain this property. 7 Section 4. The Department of Housing and Neighborhood Programs of the 8 City of Little Rock is also authorized to raze and remove said buildings and file and 9 enforce a lien against said property for the cost of razing and removing said structures 10 pursuant to Section 20 -32 of the Little Rock Code of Ordinances. I 1 Section 5. Unless the provisions of this Ordinance are put into effect 12 immediately, the public health, safety and welfare of the citizens of Little Rock will be 13 adversely affected; therefore, an emergency is hereby declared to exist, and this 14 ordinance shall be in full force and effect from and after its passage. 15 PASSED: August 1, 2005 IV 17 ATTEST: is a'4'& .� h4Vt 19 UU 20 ataki S.
