I was at a meeting when this was discussed, and we agreed in principle to not enforce the requirement to widen Rahling until Whisenhunt completed their street improvements. There are two other things in the letter that were not discussed at the meeting I attended. Our first discussion did not include the widening of the north slope of Chenal, presumably because it was not included in the traffic study area. The other thing is how to interpret the deferral ordinance. Mr. Spivey mentions that widening Rahling is not required until a second collector connection is constructed at Beckingham or Plantation. I read the ordinance to say that now that three years elapsed and the Pebble Beach connection has been made, widening of Rahling would be required at 12,000 vpd. Elm El Dorado, Arkansas 71731-7200 Dear Mr. Dillon This letter is written to respond to the concerns expressed by Deltic Timber Corporation to the City regarding boundary street construction obligations of Whisenhunt Investments ("Whisenhunt") and Deltic Timber Corporation ("Deltic"). As you know, Whisenhunt is in the process of constructing new streets and boundary street improvements associated with the Shackleford Farms Planned Commercial Development. Over the coming months, a network of arterial and collector streets will be constructed to serve the Fellowship Bible Church site that includes Kirk Road (from Chenal parkway on the South to Rahling Road on the North) and, Wellington Hills Road (from the current terminus of Wellington Hills Road to the junction with Systems Drive. For the property located along Chenal Parkway and Kanis Road, Whisenhunt has agreed to construct improvements to Chenal Parkway, Kanis Road west, and the intersections of Chenal Parkway with Kirk Road and Chenal Parkway with Kanis Road. Pursuant to Ordinance Number _, Deltic has a present right to widen and improve Rahling Road to an arterial street standard when traffic counts on Rahling Road reach a weekday average of 12,000 vehicles per day and the City connects or approves connection of a second collector street at either Beckenham or Plantation Drive. Deltic has also agreed to construct additional lanes of the traffic on Chenal Parkway north of St. Margaret's Episcopal Church when the traffic counts on Chenal Parkway reach a weekday average of 12,000 vehicles per day. With the opening of Fellowship Bible Church on the Shackleford property and the Promenade Shopping Center in the next few months, traffic counts on Chenal Parkway and Rahling Road may exceed the 12,000 vehicle threshold. Based on the current schedule provided by Whisenhunt, the improvements Whisenhunt has agreed to construct will not be completed until the summer of 2008 or after. Until all of the Whisenhunt street construction is complete, there will be temporary road and lane closures throughout the project area. This may cause additional, temporary increases in traffic counts on Chenal Parkway and Rahling Road that may not accurately reflect the average daily traffic volumes once all street construction is complete. Therefore, the City agrees with your position that it would not be fair or accurate to use traffic count data taken before all of the Whisenhunt street improvements are in place as a basis to request that Deltic commence construction of additional street improvements on Chenal Parkway or Rahling Road. Accordingly, the City agrees not to 740327-v1 , 2008 Page 2 request that Deltic undertake construction of any additional improvements on Chenal Parkway or Rahling Road until the Whisenhunt street improvements have been constructed and completed as originally contemplated and traffic flows in the overall area have been normalized. The Chenal valley Municipal Property owners 32 Multi -Purpose Improvement District No. 4 of 33 the City of Little Rock, Arkansas, or the' 34 petitioners for said district, or both, shall 35 have the right to: 36 (i) Build the West Loop, as shown on the �smuss �3sSSSS�zG- Master Street Plan, from Chenal Parkway in an easterly and northerly direction to the Taylor Loop/Hinson Road connector, consisting of two lanes and a turn lane; Improve the West Loop to arterial standards at such time as the traffic count on the road reaches 12,000 vehicles•per day, provided, however, that there shall be no obligation to improve the West'Loop to arterial standards unless the connections referred to in subparagraph (iii) below shall have been constructed; Connect Pebble Beach Road to the West Loop at any time if one other collector to the West Loop is connected, provided that if no other collector is connected to the West Loop at the end -of three years from the date of this ordinance, then Pebble Beach shall be connected at that time. SECTION 2. All developers of property along the West Loop, as shown on the Master Street Plan, shall post signs at the end of collector streets which explain that these streets, or street stubs, shall be extended at some point in the future. SECTION 3. The City shall post signs on present collector streets that show these streets will will continue to be shown on the Master Street Plan as collector streets. SECTION 4. The City shall assure that along the West Loop, as shown on the Master Street Plan, engineering techniques that serve as traffic calming devices shall be maintained. SECTION 5. SEVERABILITY. SECTION 6. REPEALER: This ordinance shall repeal all other ordinances or resolutions that govern the topic of this ordinance to the extent of any inconsistency.
