HomeMy WebLinkAboutdraft letter to Spivey from Stodola boundary streetNovember 28, 2008 Mr. John William Spivey III Attorney, Chenal Valley Municipal Improvement District #4 Wright, Lindsey & Jennings LLP 200 West Capitol, Suite 2300 Little Rock, AR 72201-3699 Dear Mr. Spivey: This letter is written to respond to the concerns that you expressed to me regarding boundary street construction obligations of the Whisenhunt Development and Deltic Timber. As you know, Whisenhunt is in the process of constructing new streets and boundary street improvements associated with the Shackleford Farms Planned Commercial Development. Over the coming months, a network of arterial and collector streets will be constructed to serve the Fellowship Bible site that includes Kirk Road, Wellington Hills Road, and Wellington Colony. For the property located along Chenal and Kanis, the Whisenhunt Developers have agreed to construct improvements to Chenal, Kanis west, and the intersections of Chenal with Kirk and Chenal with Kanis. Your client, Deltic, has made a commitment to widen and improve Rahling Road to an arterial street standard when traffic counts on Rahling reach a weekday average of 12,000 vehicles per day. With the opening of Fellowship Bible Church on the Shackleford property and the Promenade on Chenal and Rahling, you believe traffic counts an Rahling will exceed the 12,000 vehicle threshold. Your concern at this time is with the timing of the completion of the Whisenhunt improvements. Based on the current schedule provided by the Whisenhunts, these improvements will not be completed until summer 2008. Until all of the Whisenhunt street construction is complete, there will be temporary road and lane closures throughout the project area. This may cause additional, temporary increases in traffic counts on Rahling Road that may not accurately reflect the average daily traffic volumes once all street construction is complete. Therefore, I agree with your position that it would not be fair or accurate to use traffic count data taken before all of the Whisenhunt improvements are in place as a basis to enforce the ordinance provision to widen Rahling Road.
