HomeMy WebLinkAbout15329 1 RESOLUTION NO. 15,329 2 3 A RESOLUTION TO RECOGNIZE A VARIANCE FROM CHAPTER 13 4 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, 5 ARKANSAS, FROM THE CONSTRUCTION STANDARDS OF 6 STRUCTURES LOCATED WITHIN THE 100-YEAR FLOODPLAIN FOR 7 THE NATURAL STATE WELLNESS DISPENSARY, LOCATED AT 900 8 SOUTH RODNEY PARHAM ROAD, LITTLE ROCK, ARKANSAS; AND 9 FOR OTHER PURPOSES. 10 11 WHEREAS, The Little Rock Board of Directors has adopted ordinances regulating the construction 12 of structures located within the designated and regulated floodplain of Rock Creek, currently codified in 13 Chapter 13 of the Municipal Code of Ordinances, and 14 WHEREAS, Section 13-57 of the Municipal Code provides that the Little Rock Board of Directors 15 may grant variances to the standards for construction of structures within the floodplain as provided for in 16 the Code. Therefore, 17 THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF 18 LITTLE ROCK,ARKANSAS: 19 Section 1. That the structure located at 900 South Rodney Parham Road and currently occupied by 20 the Natural State Wellness Dispensary be granted a variance from the construction standards for 21 structures located within the 100-Year Floodplain as codified in Chapter 13 of the Municipal Code of 22 Ordinances. 23 Subsection a. Chapter 13, Section 60(1)(b) requires the top of the finished floor of non- 24 residential structures be elevated to one (1)-foot or more above the base flood elevation of Rock 25 Creek (315.8 feet MSL). The top of the finished floor of the dispensary was constructed to 26 elevation 316.3 feet MSL which is less than one (1)-foot above the base flood elevation of Rock 27 Creek. 28 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 29 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 30 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 31 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 32 resolution. 33 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 34 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
