AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED
COMMERCIAL DISTRICT TITLED RUSH ENGINE DBA
TRIUMPH OF ARKANSAS SHORT -FORM PCD (Z- 7838),
LOCATED AT 4100 SOUTH UNIVERSITY AVENUE,
LITTLE ROCK, ARKANSAS, AMENDING THE
OFFICIAL ZONING MAP OF THE CITY OF LITTLE
ROCK; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described property
be changed from C -3 to PCD:
Part of the SW 1/4 of the SW 1/4 of Section 18, Township 1 North, Range 12
West, and part of the SE 1/4 SE 1/4 of Section 13, Township 1 North, Range
13 West, City of Little Rock, Pulaski County, Arkansas, being more
particularly described as follows; Commencing at the SW corner of said
Section 18, thence along the south line of said SW 1/4 SW 1/4, Section 18,
N88 050'57 "E 56.04 feet for the point of beginning; thence along a curve to
the left having a radius of 375.0 feet, an arc distance of 174.42 feet and a
chord bearing and distance of N50 °27'21 "W 172.85 feet to a point on the
Easterly right of way line of University Avenue (US Highway 67 -70);
thence along said right of way line N08 °33'08 "E 294.13 feet; thence
S81 021'36 "E 310.51 feet; thence N08 °42'47 "W 240.80 feet to a set 1 /z"
rebar; thence S53 °27'03 "E 515.13 feet to the east line of the Requa Tract;
thence along said East line of Regua Tract S01 038'03 "W 299.84 feet to the
South line of said SW 1/4 of Section 18; thence S88 °50'57 "W 659.46 feet
to the point of beginning.
SECTION 2. That the preliminary site development plan/plat be approved as
recommended by the Little Rock Planning Commission.
SECTION 3. That the change in zoning classification contemplated for Rush
Engine DBA Triumph of Arkansas Short-form PCD is conditioned upon obtaining a final
plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of
the Code of Ordinances.
SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 1 hereof
SECTION 5. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 6. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
