3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO AN AGREEMENT WITH ARKANSAS HIGHWAY AND
5 TRANSPORTATION DEPARTMENT FOR UTILIZATION OF
6 ARKANSAS RECREATIONAL TRAIL FUNDS FOR THE JUNIOR
7 DEPUTY SECTION OF THE ARKANSAS RIVER TRAIL; AND FOR
8 OTHER PURPOSES.

10 WHEREAS, in 2005 a grant was applied for and awarded to construct the Junior
11 Deputy section of the Arkansas River Trail, and
12 WHEREAS, a contract for this construction was bid in the Fall of 2005 and the
13 Board of Directors authorized the City Manager to enter into a construction contract in
14 February 2006, and
15 WHEREAS, clearance letters have been obtained from the appropriate state
16 agencies to initiate the project.
17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
18 THE CITY OF LITTLE ROCK, ARKANSAS:
19 Section 1. The Board of Directors hereby authorizes the City Manager to enter
20 into an agreement with the Arkansas Highway and Transportation Department for
21 utilization of Arkansas Recreational Trail grant funds for the Junior Deputy Section of
22 the Arkansas River Trail.
23 Section 2. Funds for the City's portion of the matching 80/20 grant are available
24 through the 2004 Bond Issue.
25 Section 3. Severability. In the event any title, section, paragraph, item, sentence,
26 clause, phrase, or word of this resolution is declared or adjudged to be invalid or

1 unconstitutional, such declaration or adjudication shall not affect the remaining
2 portions of the resolution which shall remain in full force and effect as if the portion so
3 declared or adjudged invalid or unconstitutional was not originally a part of the
4 resolution.
5 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that
6 are inconsistent with the provisions of this resolution, are hereby repealed to the extent
7 of such inconsistency.
