3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ENTER INTO AN
5 AGREEMENT WITH MOTOROLA, IN AN AMOUNT NOT TO EXCEED
6 NINETY-SIX THOUSAND, NINE HUNDRED EIGHTY-EIGHT AND
7 30/100 DOLLARS ($96,988.30), PLUS APPLICABLE TAXES AND FEES,
8 TO UPGRADE SOFTWARE AND HARDWARE FOR THE NICE IP
9 RADIO LOGGER UPGRADE AND MAINTENANCE USED BY THE
10 LITTLE ROCK POLICE DEPARTMENT COMMUNICATIONS (911)
11 DIVISION; AND FOR OTHER PURPOSES.

13 WHEREAS,the Little Police Department has a need to enter into a sole-source contract with Motorola,
14 the parent company ofNICE,to upgrade existing software and hardware of the Communications Division's
15 Inform Recorder and provide five(5)years of maintenance therefore; and,
16 WHEREAS,the NICE Inform Recorder is used by the Communications Division to record incoming
17 phone lines, including 911 lines has reached its functional end of life and must be upgraded to ensure the
18 equipment's continued operation; and,
19 WHEREAS, the majority of the funds will come from the 2019 Edward Byrne Justice Assistance
20 Grant, monies from which must be spent by September 30, 2022. Maintenance for the periods after
21 September 30,2022,will come from a Little Rock Police Department account.
22 WHEREAS, the cost of the software and hardware upgrade is Ninety-Six Thousand, Nine Hundred
23 Eighty-Eight and 30/100 Dollars($96,988.30), plus applicable taxes and fees.
24 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
25 OF LITTLE ROCK,ARKANSAS:
26 Section 1. The City Manager is authorized to enter into a sole-source contract with Motorola, the
27 parent company of NICE to upgrade existing software and hardware of the Communications Division's IP
28 Radio Logger and to provide maintenance therefore at a cost not to exceed Ninety-Six Thousand, Nine
29 Hundred Eighty-Eight and 30/100 Dollars($96,988.30),plus applicable taxes and fees.
30 Section 2. Funding for the software and hardware upgrade and maintenance is available from the
31 following sources: Sixty-Five Thousand, Six Hundred Eleven and 30/100 Dollars ($65,611.30) from the
32 2019 Edward Byrne Justice Assistance Grant, Account No. 270529—G35171, and Thirty-One Thousand,

1 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
2 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
3 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
5 ordinance.
6 Section 4. Repealer. All laws, ordinances, resolutions,or parts of the same,that are inconsistent with
7 the provisions of this ordinance, are hereby repealed to the extent of such inconsistency.
