3 AN ORDINANCE TO AMEND CHAPTER 8 OF THE LITTLE ROCK
4 CODE OF ORDINANCES; TO PROVIDE FOR THE ADOPTION BY
5 REFERENCE OF THE 2004 ARKANSAS ENERGY CODE AND THE
6 2003 INTERNATIONAL ENERGY CONSERVATION CODE WITH
7 APPENDIX, AND FOR OTHER PURPOSES.

9 WHEREAS, Little Rock, Ark. Rev. Code 8 -28(D) adopts by reference the 2004
10 Edition of the Arkansas Energy Code, and 8 -28(b) adopts by reference the 2003
11 International Energy Conservation Code with appendix.
12 WHEREAS, the City has complied with Ark. Code Ann. §14 -55 -207 (1987) by
13 publishing a notice of intent to adopt these technical codes by reference in a paper of
14 general circulation within the municipality and three copies of codes have been
15 available for inspection in the City Clerk's office by the public prior to their adoption;
16 and
17 WHEREAS, this Ordinance amendment is necessary to update the City Code
18 and authorize the use of the 2004 Arkansas Energy Code and the 2003 International
19 Energy Conservation Code with appendix within the City.
20 NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
21 THE CITY OF LITTLE ROCK, ARKANSAS:
22 Section 1. This section of Little Rock, Ark. Rev. Code � 8 -28(D) (1988) is
23 hereby amended to read as follows:
24 (a) The following publications are adopted by reference:
25 (1) The "2004 Arkansas Energy Code ".
26 (2) The "2003 International Energy Conservation Code" with appendix.

I Section 2. Severability. In the event any title, section, paragraph, item, sentence,
2 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
3 unconstitutional, such declaration or adjudication shall not affect the remaining
4 portions of this ordinance, which shall remain in full force and effect as if the portion so
5 declared or adjudged invalid or unconstitutional was not originally a part of this
6 ordinance.
7 Section 3. Repealer. All ordinances or resolutions of the City in conflict herewith
8 are hereby repealed to the extent of such conflict.
