I would like to take this time to respond to your question of "how did a rezoning request for a home turn into a full fledged land use plan amendment..." When an applicant initiates a rezoning request, that request is checked to determine if the proposal is in conformance with the Land Use Plan. If the proposed zoning is compatible with the land use category, a Land Use Plan is not necessary. For example, if the zoning request is for C-1 Neighborhood Commercial and the Land Use Plan classification is NC - Neighborhood Commercial or C — Commercial, it would most likely be compatible and therefore a Land Use Plan amendment would most likely not be required. However, if the proposed zoning is not compatible with the Land Use Plan classification, in this case C-1 Neighborhood Commercial zoning in a SF Single Family land use classification, a Land Use Plan Amendment is necessary. The Land Use Plan is to promote an orderly growth pattern, to guide development, and to direct infrastructure decisions which will create a strong livable community. It is a blueprint, or vision of what the city should become. When a landowner initiates a zoning request and if it is not compatible with the Land Use Plan, it is necessary for the city planning staff, the Planning Commission and the Board of Directors to revisit that vision or blueprint. The planning staff analyzes all land use plan applications. One of the many factors that the analysis includes is the possible expansion of the area. Staff may expand an application to include other properties if it is appropriate and in accordance with standard planning theories. This application was expanded to include the house across the street. Planning Staff may or not be in favor of the change, but if it is approved by the City of Little Rock Board of Directors, it makes better planning sense to have both houses included in the Land Use Plan amendment. By the time that you receive this letter, the Planning Staff will have made public our recommendation on the zoning and Land Use Plan amendment. Staff has recommended denial of both applications. Per our normal procedure, Public Works Staff has reviewed this application. They will be at the September 14, 2000 Planning Commission meeting and will discuss the floodway/floodplain issue before the commissioners. ( I have attached a copy of the applicants letter describing what they envision for this property). I later received a postcard in the mail from'. That doesn't appear to be what was asked for in the .application. I have had calls from some of our neighbors after the rezoning/plan amendment signs appeared in the front yard of the residence at 10800 Birchwood, particularly r eighbors to the west of this home. We totally oppose any rezoning or amendment to the plan from residential to commercial at this entrance (Shadcleford & Birchwood) to our neighborhood. As the old adage goes, "give them an inch, they will take a mile." There hav:: already been inquiries to buy up the first five houses on Birchwood. It would be opening the door to further commercial intrusion into our neighborhood. Tha Naveros have- cinly been here possfbiy-year, we have' I ived here for 30 years as have many others and have been inundated with these types of requests, We do not wish to see more of th a, type of commercialization at yet another entrance to our neighborhood. Does every comer in the city of Little Rock have to be a commercial node? We already have that type o1' zoning at the other two entrances into our neighborhood on Autumn and Chenal Pkwy. and Alamo and Markham, do we really need another? The- current application 'would only exacerbate the traffic situation at this intersection. According to the' 1997 Highway Dept. traffic report there were at that -time 34,000 cars driving `south bn' Shackleford with another 36,000 cars gding.'east',orf! Finarfcial Center which,'makes'-a totarof 70,000 at Shackleford'& Fihi�riciaP"Ceriter/l,:630,approzimately 70,000 cars i'day whichi has made this the busiest intE rsectiori in the city. It all'backs up on Shaddeford to the north and blocks Birchwood to ar y incoming or outgoing traffic. That count was made three years ago, we can only imac lne what that count is today. As 09/07/00 15:08 FAX. 501 571 4498 LITTLE 0CR AR CITY MGR [a 005 indicated in the City's Master Street Plan, the serviw- volume for Principal Arterials is 25,000 vehicles per day, clearly the volume of traffic fc r this location is totally in excess of that figure (Chenal Parkway Corridor Traffic Study - 1995)_ That is only one of the problems facing this land use amendment/rezoning and as 1 understand it, not the prevailing issue. it is also in the Flood Plain (map attached). There was a similar request in March 1992 for the same type of rezoning that involved two homes on the south side of Birchwood. I am enclosing a copy of a letter written by Jim Lawsor at that time to Sharon Priest who was mayor then, it explains why this was not a good id(Da for our neighborhood then and still isn't today. There have been previous applicatic cis at this -locality for this type of rezoning. in the.pasL including the people the current re.-Ade�ats bo�jght the horse from, a41 of which failed or withdrawn. We hope this record Y► II* remain intact. I have spoken with Ms. Novero and was told their reaso -i for wanting the rezoning is to be able to stay at home with her alteration business. Horn a Occupation has been explained to her and that she would have to go to the customers, t-iey would not be allowed to come to her home. She has said she wouldn't be interested in this type bf arrangement. The only reason I can see that they would request this re;:oning is to get out from under the overhead at their current place of business at 10500 W.
