3 A RESOLUTION AUTHORIZING USE OF EMINENT DOMAIN ON THE
4 13TH STREET DRAINAGE PROJECT AND THE BOWMAN ROAD
5 IMPROVEMENT PROJECT; AND FOR OTHER PURPOSES.

7 WHEREAS, it is critical to acquire all of the right-of-way, real estate, Permanent and Temporary
8 Construction Easements necessary for the construction of the 13`x' Street Drainage Improvement Project,
9 west of Rice Street,and the Bowman Road Improvement Project,from Kanis Road to Cherry Laurel Drive,
10 and move these projects to construction in a timely manner; and,
11 WHEREAS, staff will continue to acquire the necessary property and easements without the use of
12 eminent domain wherever possible and negotiate the purchases at or above Fair Market Value.
13 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
14 OF LITTLE ROCK,ARKANSAS:
15 Section 1. The City Manager and City Attorney are hereby authorized to use eminent domain to
16 complete acquisition of right-of-way, real estate, Temporary Construction Easements and Permanent
17 Construction Easements necessary for construction of the 13' Street Drainage Project and the Bowman
18 Road Improvement Project as shown on the plans for right-of-way acquisition.
19 Section 2. Funding for these projects are available from 3/8-Cent Capital Improvement Sales and
20 Compensating Use Tax and the Limited Tax General Obligation Capital Improvement Bonds for Streets
21 and Drainage as previously authorized by Resolution No. 14,803.
22 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
23 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
24 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
25 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
26 resolution.
27 Section 4. Repealer.All laws, ordinances, resolutions,or parts of the same,that are inconsistent with
28 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
