MEMORANDUM

Subject: Land Use Plan at 8806 Mabelvale Pike
Date: November 19, 1999
Brian Minyard of Planning and Development Staff and Jim Lawson met with the
applicants on November 19 concerning their application for a Land Use Plan amendment
that was heard at the November 16, 1999 Board of Directors meeting. The applicants
Terrance Dolan and John Findley were present.
Attached to this memo is a color map of the area in question. The map shows the
property ownership for the north three-quarters of Section 34 as verified with the Tax
Assessors office on November 17. The applicants' property is shown with a red star.
Their property is the only property included in the Land Use Plan Amendment. The
large swath of dark blue is the floodway and the lighter blue surrounding it is the
floodplain. Their property has some area in the floodplain, but most of it is out.
The following items were discussed. Delta Coleman, which the applicant represents, has
owned the property since 1988. Since that time, they have cut and sold timber and have
recently bushogged the land. Brian Minyard, as standard operating procedure, visited the
site in mid September 1999. They drove along the paved road past the applicants'
property and through the Terry and McGowan properties. They did not notice any
evident violations on the applicant's property. Mr. Minyard stated that it looked like
"pasture land". There were abandoned machinery, trash, and heavy machinery on the
other properties, but not on the applicant's property.
The paved road extends about a thousand feet to the west of Mabelvale Pike. Though not
curbed and guttered, it was paved — not a dirt road.
Access has been denied from Windsor Court. The road to the south from the Alix
property had been eliminated and was not evident to Mr. Minyard at the time of his site
visit.
Public Works has been asked about any violation of floodway or dumping. Bob Turner,
Assistant Director, has stated that he is unaware of any violations of that sort in the area.
