SUBJECT: Land Use Plan — Proposed Changes
Dear Walter:
As you know from our earlier meeting, I represent the Martin Revocable Living Trust and the Mary M Garner Trust,
to whom you recently sent letters addressing potential Land Use Plan changes affecting land they own on both sides
of Mabelvale Pike, south of I-30. They have authorized me to send this letter addressing their position regarding the
proposed changes.
First, with regard to the proposed change of the land west of Mabelvale Pike from LI to SO, the owner is not in
agreement with that change and respectfully asks that the designation remains on the Future Land Use Plan as Light
Industrial. They believe LI most accurately represents the most likely development of the property, and is more in
keeping with property usage and demand in the area than Suburban Office.
Second, with regard to the proposed change of the land east of Mabelvale Pike from C to MX, the owner would also
prefer that the land remain designated on the Future Land Use Plan as Commercial and not be changed to Mixed
Use. The most likely eventual development of this land is difficult to determine. The owners, based on what I've
reported to them from my discussions with you, can see some potential situations in which they might benefit from
the C designation and some potential situations in which they might benefit from the MX designation, but they do
not feel one set of scenarios is clearly more likely than the other and they do not think the property development
patterns in the area warrant a Land Use Plan change for their tract of land. I would be happy to visit with you again
about this one if you think we don't understand the city's recommendation properly.
In prioritizing these matters, my client is relatively more opposed to the proposed change on the west side of the
street than the one on the east side, but based on our understanding they would prefer that both designations be left
unchanged.
