ORDINANCE NO. 19,491
3 AN ORDINANCE TO ABANDON UTILITY AND DRAINAGE
4 EASEMENTS LOCATED WITHIN LOTS 15,16A AND 16R, TOWNE
5 OAKS ADDITION, LOCATED AT THE NORTHWEST CORNER OF
6 RODNEY PARHAM AND RESERVOIR ROADS, IN THE CITY OF
7 LITTLE ROCK; AND FOR OTHER PURPOSES.

9 WHEREAS, a request was made to abandon specifically described portions of
10 utility and drainage easements located within Lots 15, 16A and 16R, Towne Oaks
11 Addition, located at the Northwest corner of Rodney Parham and Reservoir Roads,
12 pursuant to the City's general police power authority under Ark. Code Ann. § 14 -54-
13 104;
14 WHEREAS, the Board has determined that the abandoning of these utility and
15 drainage easements will not have an adverse impact on the adjacent property owners
16 and the easement abandonment will not become effective until facilities are removed or
17 relocated and new easements are dedicated.
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
19 OF THE CITY OF LITTLE ROCK, ARKANSAS:
20 Section 1. The Board of Directors hereby releases, vacates, and abandons the
21 utility and drainage easements located within the following described properties, in the
22 City of Little Rock, Pulaski County, Arkansas:
23 The East 5 feet of the North 233.29 feet and the North 10 feet of the East
24 56.31 feet of Lot 15, Towne Oaks Addition in the City of Little Rock,
25 Pulaski County, as filed for record in plat book 38, page 62, containing
26 0.039 acres (1,677 sq. ft.), more or less.

2 The West 5 feet of the North 232.83 feet and the North 10 feet of Lot 16A,
3 Towne Oaks Addition to the City of Little Rock, Pulaski County,
4 Arkansas, as filed for record in plat book 39, page 21, containing 0.052
5 acres (2,276 sq. ft.), more or less.
6 AND
7 The South 10 feet of the East 168.83 feet of Lot 16R, Towne Oaks Addition
8 to the City of Little Rock, Pulaski County, Arkansas, as filed for record in
9 plat book 39, page 71, containing 0.039 acres (1,700 sq. ft.), more or less.
10 Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed
11 in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of
12 Pulaski County, Arkansas.
13 Section 3. Severability. In the event any title, section, paragraph, item,
14 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
15 or unconstitutional, such declaration or adjudication shall not affect the remaining
16 portions of the ordinance which shall remain in full force and effect as if the portion so
17 declared or adjudged to be invalid or unconstitutional were not originally a part of the
18 ordinance.
19 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same
20 that are inconsistent with the provisions of this ordinance are hereby repealed to the
21 extent of such inconsistency.
