HomeMy WebLinkAbout19490ORDINANCE NO. 19,490 AN ORDINANCE REVOKING ORDINANCE NO. 19,305 WHICH VACATED AND ABANDONED A 70 -FOOT PORTION OF THE 60 -FOOT WIDE PUBLIC RIGHT -OF- WAY OF WEST 10TH STREET LOCATED BETWEEN SPRING AND BROADWAY STREETS, IN THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES. (G -23- 341 -A) WHEREAS, a request was made to abandon a portion of the public right -of -way of West 10th Street, immediately west of the alley right -of -way within Block 109, Original City of Little Rock, pursuant to the City's general police power authority under Arkansas Code Annotation § 14 -54 -104; and WHEREAS, on April 5, 2005, the Board of Directors of the City of Little Rock, Arkansas passed Ordinance No. 19,305 releasing, vacating and abandoning the portion of said right -of -way; and WHEREAS, it has now been determined that the portion of said right -of -way is now needed for corporate purposes and the abandonment of the right -of -way did have an adverse impact on the adjacent property owner. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. Ordinance No. 19,305 which vacated and abandoned a portion of the public right -of -way of West 10th Street, immediately west of the alley right -of -way within Block 109, Original City of Little Rock, is hereby revoked. SECTION 2. A copy of this ordinance duly certified by the City Clerk shall be filed with in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas. SECTION 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was not originally a part of the ordinance. SECTION 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
