HomeMy WebLinkAbout19488ORDINANCE NO. 19,488 AN ORDINANCE AMENDING ORDINANCE NO. 18,633, REVOKING THE PLANNED COMMERCIAL ZONING DESIGNATION FOR ONE LOT OF THE ROGERS SHORT - FORM PCD LOCATED AT 2407 BATTERY STREET IN THE CITY OF LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. (Z- 4985 -F) WHEREAS, on January 15, 2002, Ordinance No. 18,633 was passed by the Board of Directors of the City of Little Rock, Arkansas, which established on Planned Commercial District titled Rogers Short-Form PCD; and WHEREAS, the structure on Lot 2, Block 9, McCarthy Addition to the City of Little Rock, Arkansas has been physically separated from the structure previously approved for Rogers Short-Form PCD and is no longer a part of the PCD; and WHEREAS, the property owner has requested that the PCD zoning be revoked for this one lot and the previous zoning of R -4, Two - Family Residential be restored; and WHEREAS, at its January 19, 2006 meeting, the Planning Commission of the City of Little Rock, Arkansas voted to recommend approval of the revocation request by a vote of 10 ayes, 0 noes and 1 absent. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Ordinance No. 18,633 is hereby amended to remove the property described as Lot 2, Block 9, McCarthy Addition to the City of Little Rock, Arkansas from the Rogers Short-Form PCD. SECTION 2. That the preliminary site development plan/plat approved by Ordinance No. 18,633 is hereby amended to remove the property described as Lot 2, Block 9, McCarthy's Addition to the City of Little Rock, Arkansas. SECTION 3. That the PCD classification of the property described as Lot 2, Block 9, McCarthy's Addition to the City of Little Rock, Arkansas is hereby revoked and the former R -4 Two - Family Residential zoning classification is restored on the official zoning map. SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock and designated district map be and it is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 3 hereof. SECTION 5. That this Ordinance shall take effect and be in full force 30 days after the side of its passage and approval. SECTION 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
