3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REVISED CODE
4 § 2 -243 (1988) TO RECOGNIZE DEVELOPMENT FEES CONSULTANT
5 AS A PROFESSIONAL SERVICE FOR THE CITY OF LITTLE ROCK,
6 ARKANSAS, AND FOR ITS VARIOUS BOARDS AND
7 COMMISSIONS; AND FOR OTHER PURPOSES.

9 WHEREAS, Ark. Code Ann. § 19 -11 -801 (Michie Repl. 2005), regarding the
10 designation of professional services, authorizes a political subdivision to include as
11 professional services such consulting services as the political subdivision shall
12 designate by two- thirds (2/3) vote of its governing body, and
13 WHEREAS, the Board of Directors of the City of Little Rock, Arkansas, finds that
14 price or cost bidding for the provision of the services of a development fees consultant
15 to perform a study to form the basis of a Street Development Fee ordinance is
16 impracticable, unfeasible, or, if based solely on price, would result in an outcome that
17 would not meet the best interests of the City, and
18 WHEREAS, for the services of a development fees consultant, this declaration on
19 an ongoing basis is appropriate.
20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
21 OF THE CITY OF LITTLE ROCK ARKANSAS:
22 Section 1. Little Rock, Ark., Rev. Code § 2- 243(a)(2) (1988) is hereby amended to
23 add subsection (u) and read as follows:
24 (2) All services declared to be a professional service if done for or on
25 behalf of the City, its boards, commissions or authorities, including the
26 following:

I Section 3. Severability. In the event any portion of this ordinance is declared or
2 adjudged to be invalid or unconstitutional, such declaration or adjudication shall not
3 affect the remaining portions of this ordinance, which shall remain in full force and
4 effect as if the portion so declared or adjudged invalid or unconstitutional was not
5 originally a part of this ordinance.
6 Section 4. Repealer. All ordinances and resolutions, and parts thereof, which
7 are in conflict with any provision of this ordinance are hereby repealed to the extent of
8 such conflict.
